【摘要】：中國與西方為其理想的司法者所造的形象各有不同。中國作為理想司法者標(biāo)志的是鐵面三眼的包公,而西方作為理想司法者標(biāo)志的則是蒙眼持秤的女神。本文首先分析了司法的目的(追尋個(gè)案判決的妥當(dāng)、同類案件判決的協(xié)和以及終極的社會(huì)理想),其次討論了中西文化特質(zhì)對(duì)于追尋此目的的方法所生的歧異(比較詳細(xì)地闡述了中國為了追尋此目的,在理論、制度和實(shí)踐方面的演變過程),然后談到司法工作本質(zhì)上的限制和司法者的功能,指出中西兩種圖像所表達(dá)的期望都有問題,應(yīng)該加以修正。
[Abstract]:China and the West have different images of their ideal jurists. China is the symbol of the ideal judiciary, and the west as the symbol of the ideal judiciary is the goddess of blindfolded scales. First of all, this paper analyzes the purpose of the administration of justice. The consonance of similar cases and the ultimate social ideal are discussed. Secondly, the differences between Chinese and Western cultural characteristics on the methods of pursuing this aim are discussed in detail. The evolution process of system and practice is discussed, then the essential limitation of judicial work and the function of judiciary are discussed. It is pointed out that there are problems in the expectations expressed in both Chinese and western images, which should be revised.
