【摘要】：社會管理的目標是為追求一種有序的秩序,維持社會穩(wěn)定,尊重保障人權(quán),從而達致善治。司法過程及其判決是最生動、最直接、最豐富的實踐。每一件引起社會關(guān)注的案件,其判決對對民眾的心理及行為、對社會輿論及道德、對社會組織的行為規(guī)范及行業(yè)規(guī)則、對政府機關(guān)的行為選擇及履行服務(wù)管理職能,以及對司法機關(guān)本身都會造成諸多影響抑或重大影響。如“彭宇案”、“劉涌案”、“許霆案”、“鄧玉嬌案”、“藥家鑫案”、“李昌奎案”、“夏俊峰案”等,都顯示出司法行為及其裁判對于國家加強社會管理及其創(chuàng)新產(chǎn)生了重要影響。司法行為中,裁判文書作為判決的最終產(chǎn)物公開,逐漸引起學(xué)者和法律實踐工作者們的重視。總之,公開的裁判文書在逐漸影響著社會管理的方式。然而,如何使間接的司法判決通過裁判文書公開傳遞至社會秩序,有效地實現(xiàn)社會的創(chuàng)新管理?這個問題值得深思。 基于此,本文分為包括導(dǎo)論的四個部分對上述問題予以討論： 導(dǎo)論通過分析現(xiàn)行我國社會管理中遭遇的新問題,發(fā)現(xiàn)司法裁判的社會功能,從而提出文章所關(guān)注的問題和研究對象,同時對相關(guān)理論研究進行評述,以找到本文的研究起點。 第二部分,首先討論司法運作的不同環(huán)節(jié),包括立案、審理、裁判與執(zhí)行所具有的社會管理功能；在此基礎(chǔ)上研究司法行為與社會管理創(chuàng)新之間的關(guān)系；最后探討裁判結(jié)果的兩種處理方式,即判決與調(diào)解所具有的社會管理作用。 第三部分,主要立足于使司法裁判與社會管理創(chuàng)新的聯(lián)動與粘合。首先,行政管理是傳統(tǒng)的社會管理模式,判決對行政權(quán)力具有確定與限制的作用;其次,裁判能對社會進行規(guī)訓(xùn),是對社會管理的沖擊,對社會道德的引導(dǎo),對社會行為的規(guī)制；最后,本部分探討判決形成與司法行為的激勵與約束,判決倒逼司法行為表達方式發(fā)生了變化。 第四部分,在上述部分論述的基礎(chǔ)上,探討如何通過裁判文書的公開實現(xiàn)社會管理創(chuàng)新。首先裁判文書的公開關(guān)系社會信息公開與社會公正,是社會管理創(chuàng)新的重要方面；其次是討論裁判文書的行為導(dǎo)向；最后對裁判文書公開與裁判過程公開的聯(lián)動提出建議。 本文創(chuàng)新之處在于以社會管理創(chuàng)新為背景,探討司法行為及裁判文書公開,較好地解釋三者的關(guān)系,提出裁判文書公開是司法間接對社會管理創(chuàng)新發(fā)揮作用的重要途徑,并且據(jù)此提出裁判文書公開與社會管理創(chuàng)新聯(lián)動的具體建議。
[Abstract]:The goal of social management is to achieve good governance by pursuing an orderly order, maintaining social stability, respecting and protecting human rights. Judicial process and its judgment are the most vivid, direct and abundant practice. In each case of social concern, its judgment is directed at the psychology and behavior of the public, on public opinion and morality, on the norms of conduct and trade rules of social organizations, on the choice of conduct of government organs and on the performance of service management functions. As well as the judiciary itself will have a lot of impact or significant impact. For example, "Peng Yu case", "Liu Yong case", "Xu Ting case", "Deng Yujiao case", "Yao Jiaxin case", "Li Changkui case", "Xia Junfeng case", etc. Both show that judicial behavior and its adjudication have an important impact on the strengthening of social management and innovation. As the final product of judgment, judicial documents have attracted the attention of scholars and legal practitioners. In short, open adjudication documents are gradually affecting the way of social management. However, how to make the indirect judicial decision public transmission to the social order through the adjudication document, effectively realizes the social innovation management? This question is worth pondering over. Based on this, this paper is divided into four parts including introduction to discuss the above issues: By analyzing the new problems encountered in the current social management of our country, the introduction finds out the social function of the judicial decision, and puts forward the problems and research objects concerned in the article. At the same time, it comments on the relevant theoretical studies to find the starting point of this research. The second part first discusses the different links of judicial operation, including filing, trial, adjudication and execution of the social management functions, on the basis of this research on the relationship between judicial behavior and social management innovation; Finally, the paper discusses the two ways of dealing with the adjudication result, that is, the social management function of judgment and mediation. The third part is based on the linkage and agglutination between judicial decision and social management innovation. First, the administration is the traditional social management mode, the judgment has the function of determining and restricting the administrative power; secondly, the judge can discipline the society, is the impact to the social management, the guidance to the social morals, Finally, this part discusses the formation of judgment and the incentive and restriction of judicial behavior, and the expression mode of judicial behavior is changed. The fourth part, on the basis of the above-mentioned part, discusses how to realize the innovation of social management through the publicity of adjudicative documents. First of all, the open relationship between the public adjudication documents and social justice is an important aspect of the innovation of social management; secondly, it discusses the behavioral orientation of the adjudication documents; finally, it puts forward some suggestions on the linkage between the publicity of the adjudication documents and the openness of the adjudication process. The innovation of this paper lies in taking the social management innovation as the background, probes into the judicial behavior and the judgment document publicity, explains the relationship among them, and points out that the judicial documents publicity is an important way for the judicial indirectly to play a role in the social management innovation. And accordingly puts forward the judgment document open and the social management innovation linkage concrete suggestion.
