【摘要】：步入新世紀以來,我國經(jīng)濟實力有了顯著的提升,人民生活水平不斷提高,生活質(zhì)量不斷改善。隨著科技的發(fā)展和社會的進步,電子信息技術(shù)為日常生活帶來巨大便利的同時,高新技術(shù)類型的犯罪也成為必須要直面的毒瘤,這就要求立法機關(guān)必須制定相應的法律法規(guī),規(guī)范其行為。電子證據(jù)作為新型的證據(jù)模式由于其本身的獨特性質(zhì),決定了其固定證據(jù)模式必定與其他證據(jù)的固定模式有所不同,這就要求我們通過專業(yè)、合法的技術(shù)手段(電子證據(jù)檢驗)去提取、固定證據(jù),以尋求法律的公平、公正。本文擬對電子證據(jù)檢驗在檢察工作中的實務(wù)進行探討、研究,以解決目前電子證據(jù)檢驗在檢察工作中的不足。筆者從電子證據(jù)概念、特性等理論研究出發(fā),結(jié)合刑事訴訟中電子證據(jù)法律一般應用,將電子證據(jù)的一般特性展示出來。根據(jù)檢察機關(guān)在實際案件中,如何依法確定需要收集電子證據(jù)的主體,如何規(guī)范準確的收集到案件相關(guān)的電子證據(jù),筆者提出了以檢察技術(shù)人員為主,一般證據(jù)收集主體為輔,兩者相互結(jié)合的電子證據(jù)收集工作模式。將電子證據(jù)的收集工作劃分為檢察辦案人員的常規(guī)收集和檢察技術(shù)人員的專業(yè)收集。圍繞檢察機關(guān)在電子證據(jù)收集方面的現(xiàn)狀和存在問題進行分析,結(jié)合電子證據(jù)檢驗鑒定、勘驗、收集等相關(guān)工作規(guī)定,對檢察實務(wù)工作提出規(guī)范化建議。
[Abstract]:Since the beginning of the new century, China's economic strength has been significantly improved, the people's living standards have been improved, and the quality of life has been continuously improved. With the development of science and technology and the progress of society, electronic information technology has brought great convenience to daily life, at the same time, the crime of high-tech type has become a cancer that must be faced directly, which requires the legislature to formulate corresponding laws and regulations. Regulate their behavior. Electronic evidence as a new type of evidence mode, because of its unique nature, determines that its fixed evidence model must be different from other evidence fixed mode, which requires us to pass professional. Legal technical means (electronic evidence testing) to extract and fix evidence in order to seek legal fairness and justice. This paper discusses the practice of electronic evidence inspection in procuratorial work and studies it in order to solve the deficiency of electronic evidence inspection in procuratorial work. Based on the theoretical research of the concept and characteristics of electronic evidence, combined with the general application of electronic evidence law in criminal proceedings, the author displays the general characteristics of electronic evidence. According to how the procuratorial organ determines the subject that needs to collect electronic evidence according to law in actual cases, and how to standardize and accurately collect electronic evidence related to the case, the author proposes that procuratorial technicians should be the main body, and the general evidence collection subject should be supplemented. The combination of the two models of electronic evidence collection. The collection of electronic evidence is divided into routine collection of procuratorial case handlers and professional collection of procuratorial technicians. This paper analyzes the current situation and existing problems of electronic evidence collection in procuratorial organs, and puts forward some standardized suggestions on procuratorial practice by combining the relevant work regulations of electronic evidence inspection, identification, investigation, collection and so on.
