監(jiān)禁刑變更執(zhí)行檢察監(jiān)督問(wèn)題研究

【摘要】:監(jiān)禁刑執(zhí)行是國(guó)家強(qiáng)權(quán)色彩濃厚的領(lǐng)域,變更執(zhí)行作為其核心組成部分,是容易發(fā)生執(zhí)行腐敗的敏感地帶,金錢、人情、關(guān)系等在此大有空間可為,致使違法變更執(zhí)行的案件報(bào)道層出不窮,F(xiàn)狀的堪憂亟待檢察監(jiān)督的介入和加強(qiáng)。圍繞加強(qiáng)監(jiān)禁刑變更執(zhí)行的檢察監(jiān)督,由于實(shí)踐性強(qiáng),學(xué)界對(duì)此關(guān)注不多,主要是實(shí)務(wù)部門在主導(dǎo)和探索相應(yīng)的理論研究。在本文中筆者嘗試對(duì)監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的一些基本理論和在我國(guó)司法實(shí)踐中出現(xiàn)的具體問(wèn)題,及相應(yīng)的完善對(duì)策進(jìn)行較為系統(tǒng)的探討,希望能夠?qū)ξ覈?guó)監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的完善有所幫助。 本文分為四個(gè)部分: 第一部分為概述,依次介紹了監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的概念、具體承擔(dān)此項(xiàng)職能的組織形式、檢察監(jiān)督的內(nèi)容,并總結(jié)歸納了監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的特點(diǎn),為下文的論述做鋪墊。 第二部分論述了監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的必要性,本部分從理論到實(shí)踐分別從四個(gè)方面論述了監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的必要性:一是分權(quán)制衡原理的內(nèi)在需求;二是執(zhí)行監(jiān)督專門性的必然要求;三是維護(hù)刑事裁判的執(zhí)行力和執(zhí)行正義的需要;四是司法現(xiàn)實(shí)的需要。通過(guò)對(duì)必要性的闡述論證了監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的價(jià)值,為下文探討加強(qiáng)和完善檢察監(jiān)督的部分奠定了基礎(chǔ)。 第三部分根據(jù)我國(guó)現(xiàn)行的法律規(guī)定系統(tǒng)闡述了監(jiān)禁刑變更執(zhí)行檢察監(jiān)督的具體程序,并結(jié)合司法現(xiàn)狀分析了目前檢察監(jiān)督存在的問(wèn)題,探討監(jiān)督不力的原因。在闡述具體監(jiān)督程序時(shí),筆者分為兩部分展開(kāi):一是減刑、假釋的檢察監(jiān)督程序;二是暫予監(jiān)外執(zhí)行的檢察監(jiān)督程序,對(duì)監(jiān)督程序的論述覆蓋到了整個(gè)監(jiān)禁刑變更執(zhí)行提請(qǐng)和決策的全部環(huán)節(jié)。在分析存在的問(wèn)題時(shí),筆者從系統(tǒng)程序規(guī)定的缺乏、權(quán)力配置的缺陷及監(jiān)督主體自身的問(wèn)題三方面展開(kāi),盡可能全面詳盡地探討了其中的問(wèn)題所在。 第四部分是本文的最后一部分,是回答本論文題目之問(wèn)的關(guān)鍵所在,是本文的核心部分,筆者緊跟上文對(duì)監(jiān)禁刑變更執(zhí)行檢察監(jiān)督存在問(wèn)題的分析,提出相應(yīng)的完善之策。首先,針對(duì)法律規(guī)定不完善的問(wèn)題,提出應(yīng)發(fā)揮檢察機(jī)關(guān)在完善執(zhí)行規(guī)范中的積極作用;其次,針對(duì)變更執(zhí)行程序權(quán)力配置的問(wèn)題,提出應(yīng)確定變更執(zhí)行決定權(quán)的司法權(quán)屬性,由法院統(tǒng)一行使,并在此基礎(chǔ)上提出了兩點(diǎn)完善審判機(jī)制的建議:一是要成立專門的審判庭,二是要確立公開(kāi)聽(tīng)證的審理方式;再次,針對(duì)檢察監(jiān)督滯后的弊端,提出了建立檢察同步監(jiān)督機(jī)制的構(gòu)想;之后,針對(duì)檢察監(jiān)督手段不力的問(wèn)題,提出了完善檢察機(jī)關(guān)糾正違法制度之策;最后,針對(duì)監(jiān)所檢察能力不足的問(wèn)題,提出了完善監(jiān)督主體的建議。
[Abstract]:The execution of imprisonment is a field with strong national power. As its core component, the implementation of change is a sensitive zone prone to execution corruption. There is much room for money, human relations, relationships, etc. As a result of illegal changes in the implementation of the case reports are endless. The present situation urgently needs the procuratorial supervision to intervene and strengthen. Because of the strong practicality, the academic circles pay little attention to the procuratorial supervision around strengthening the execution of the change of imprisonment penalty, mainly because the practical departments are leading and exploring the corresponding theoretical research. In this paper, the author tries to make a systematic discussion on some basic theories of procuratorial supervision on the change of imprisonment penalty and the specific problems in judicial practice in our country, and the corresponding perfect countermeasures. It is hoped that it will be helpful to the improvement of procuratorial supervision on the change of prison sentence in our country. This paper is divided into four parts: The first part is an overview, and then introduces the concept of procuratorial supervision of prison penalty change, the specific organizational form of this function, the content of procuratorial supervision, and summarizes the characteristics of procuratorial supervision of prison penalty change. Pave the way for the discussion below. The second part discusses the necessity of procuratorial supervision of the change of imprisonment penalty. This part discusses the necessity of procuratorial supervision in four aspects from theory to practice: first, the inherent demand of the principle of separation of powers and checks and balances; The second is the inevitable requirement of executive supervision; the third is the need to maintain the execution of criminal judgment and the need to enforce justice; and the fourth is the need of judicial reality. By expounding the necessity, this paper demonstrates the value of procuratorial supervision in the reform of imprisonment penalty, which lays a foundation for the following discussion on strengthening and perfecting the procuratorial supervision. In the third part, according to the current laws and regulations of our country, the author systematically expounds the specific procedure of procuratorial supervision on the change of prison sentence, and analyzes the problems existing in the present procuratorial supervision in combination with the current judicial situation, and probes into the reasons for the ineffectiveness of supervision. In expounding the specific supervision procedure, the author divides it into two parts: one is the procuratorial supervision procedure of commutation of sentence and parole, the other is the procuratorial supervision procedure temporarily executed outside prison. The discussion of the supervision procedure covers all aspects of the request and decision of the execution of the prison sentence change. In the analysis of the existing problems, the author starts from three aspects: the lack of system procedures, the defects of power allocation and the problems of the main body of supervision itself, and discusses the problems in detail as far as possible. The fourth part is the last part of this paper, is the key to answer the question of this paper, is the core part of this paper. First of all, aiming at the problem of imperfect laws and regulations, the author puts forward that the procuratorial organs should play an active role in perfecting the enforcement norms. Secondly, aiming at the problem of changing the allocation of executive procedure power, the author puts forward that the judicial power attribute of the power to change the execution decision should be determined. On the basis of the unified exercise by the court, the author puts forward two suggestions to perfect the trial mechanism: first, to set up a special trial chamber; second, to establish the trial method of public hearing; thirdly, to deal with the shortcomings of procuratorial supervision lagging behind. Put forward the conception of establishing the procuratorial synchronous supervision mechanism; after that, in view of the problem of ineffective procuratorial supervision means, put forward some measures to perfect the procuratorial organ to correct the illegal system; finally, aiming at the problem of insufficient procuratorial capacity of the prison, The suggestion of perfecting the subject of supervision is put forward.
