【摘要】：法官作為審判人員,肩負(fù)著實(shí)現(xiàn)社會(huì)公平與正義的使命。法官的素質(zhì)決定了一國(guó)的司法水平,加強(qiáng)法官隊(duì)伍建設(shè)是一項(xiàng)關(guān)系國(guó)家興衰成敗的艱巨而復(fù)雜的歷史任務(wù)。世界各國(guó)在加強(qiáng)法官隊(duì)伍建設(shè)上普遍采取職業(yè)化發(fā)展道路,實(shí)踐表明,法官職業(yè)化建設(shè)是提高法官素質(zhì)的根本途徑,法官職業(yè)化建設(shè)符合我國(guó)國(guó)情。筆者采用歷史分析法和辯證分析法對(duì)我國(guó)法官隊(duì)伍現(xiàn)狀進(jìn)行分析,找出我國(guó)法官隊(duì)伍存在的不足之處,運(yùn)用辯證法吸取外國(guó)法院的成功經(jīng)驗(yàn),結(jié)合我國(guó)法官隊(duì)伍的實(shí)際狀況,提出了我國(guó)進(jìn)行法官職業(yè)化建設(shè)的有效路徑,從法官的遴選、法院的人事管理、法官的教育培訓(xùn)、法官的職業(yè)保障和法官的監(jiān)督等五個(gè)方面入手探索法官職業(yè)化建設(shè)的有效路徑。
[Abstract]:Judges, as judges, shoulder the mission of realizing social fairness and justice. The quality of judges determines the judicial level of a country, and strengthening the construction of judges is a difficult and complicated historical task related to the success or failure of a country. The countries all over the world generally adopt the way of professional development in strengthening the construction of judges' ranks. The practice shows that the construction of judges' professionalization is the fundamental way to improve the quality of judges, and the construction of judges' professionalization conforms to the national conditions of our country. The author uses the historical analysis method and the dialectical analysis method to analyze the present situation of the judges in our country, finds out the shortcomings of the judges in our country, absorbs the successful experience of the foreign courts by using the dialectics, and combines the actual situation of the judges in our country. This paper puts forward an effective way to build the professionalization of judges in our country, including the selection of judges, the personnel management of the courts, the education and training of judges. This paper explores the effective path of the construction of judges' professionalization from five aspects: the professional security of judges and the supervision of judges.
