【摘要】：中世紀英格蘭地方司法的歷史,生動展現(xiàn)了法庭與司法在早期國家治理中的重要角色及其運行機制。圍繞中央與地方之間的關系,在英國司法中,始終存在著自上而下的"控制"與地方追求"自治"這兩種不同的趨勢。這也導致了學界有關"集權"與"分權"的兩種不同解讀與爭論。從法社會學的視角對其加以分析后可以發(fā)現(xiàn),中世紀英格蘭各種法庭的興起與衰弱,實際上都在不同程度地回應著國家的地方治理難題,并隨著社會結構的變遷呈現(xiàn)出"控制"與"自治"的相互滲透,預示著從"劇場化"的單向度控制邁向更為多元、隱蔽與高效的國家治理策略的轉型。
[Abstract]:The history of local justice in England in the Middle Ages vividly demonstrated the important role and operation mechanism of the courts and the judiciary in the early state governance.Around the relationship between the central and the local, there are two different trends in the British judicature: top-down "control" and local pursuit of "autonomy".This also leads to two different interpretations and arguments about centralization and decentralization.From the perspective of sociology of law, it can be found that the rise and decline of various courts in medieval England are in fact responding to the difficult problems of local governance of the country to varying degrees.With the change of social structure, the mutual penetration of "control" and "autonomy" indicates the transition from "theatrical" unidirectional control to a more pluralistic, covert and efficient national governance strategy.
