【摘要】：審判公開制度作為民主社會里司法的應有形態(tài),為保障審判的公正透明、滿足人民群眾知情權的需要貢獻了重要力量。而媒體監(jiān)督權是公民言論自由權、批評建議權的合理延伸,在促進司法公正、維護社會正義、遏制司法腐敗、進行法制宣傳等方面也發(fā)揮了積極作用。在當代,審判公開與媒體監(jiān)督可說是既密切又矛盾的關系,共同的價值追求促成了二者互相配合、互相促進的良好局面,但在一些情形下,媒體監(jiān)督的不當做法卻成為了審判公開的明顯阻力。如何在兩者的沖突中尋求平衡,找到它們的合理限度,并營造有利于審判公開的媒體監(jiān)督環(huán)境,成為筆者寫作的初衷,亦是本文要研討的重點。 本文分三個部分,基本內容如下: 第一部分通過兩起典型案例的引入,重點闡述審判公開與媒體監(jiān)督?jīng)_突的表現(xiàn),并對沖突的原因進行探究,從公眾對司法公正的信任危機和媒體自身的角色錯位兩方面來進行剖析。 第二部分也引入兩起典型案例,對審判公開與媒體監(jiān)督的統(tǒng)一性和可共存性進行論證,闡述媒體監(jiān)督之于審判的積極意義,表達筆者對審判公開與媒體監(jiān)督不可偏廢的意見。 第三部分是全篇的重點,筆者在前文的基礎上,試圖厘清審判公開與媒體監(jiān)督的合理限度。通過對域外法的經(jīng)驗的借鑒,以及對中國立法司法實踐的思考,重點從六方面為營造良好的媒體監(jiān)督環(huán)境作出努力,包括設立平衡兩者關系的指導原則、設定資格審查程序規(guī)范媒體直播報道行為、對媒體報道的限制適度放開、制定司法傳媒行為統(tǒng)一規(guī)范、對媒體監(jiān)督影響公正審判進行補救和新聞行業(yè)的自我調節(jié)。
[Abstract]:As a proper form of justice in a democratic society, the open trial system contributes an important power to ensure the fairness and transparency of the trial and to meet the needs of the people's right to know, while the right of media supervision is the right of citizens to freedom of speech. The rational extension of the right of criticism and suggestion has also played a positive role in promoting judicial justice, safeguarding social justice, curbing judicial corruption and propagating the legal system. In contemporary times, open trial and media supervision can be said to be a close and contradictory relationship. The pursuit of common values has contributed to a good situation in which the two cooperate and promote each other, but in some cases the improper practice of media supervision has become a clear resistance to open trials. How to strike a balance between the two conflicts, Finding their reasonable limits and creating a media supervision environment conducive to open trial becomes the original intention of the author's writing and is also the focus of this paper. This paper is divided into three parts, the basic content is as follows:. The first part, through the introduction of two typical cases, focuses on the performance of the conflict between open trial and media supervision, and explores the causes of the conflict. This paper analyzes the crisis of public trust in judicial justice and the mismatch of the media's own role. The second part also introduces two typical cases to demonstrate the unity and coexistence between open trial and media supervision, expounds the positive significance of media supervision in trial, and expresses the author's opinion on trial openness and media supervision. The third part is the focus of the whole article. On the basis of the above, the author tries to clarify the reasonable limits of open trial and media supervision. Focusing on six aspects of efforts to create a good media supervision environment, including the establishment of guiding principles to balance the relationship between the two, the establishment of a qualification review procedure to regulate the conduct of live media coverage, and the moderate release of restrictions on media reporting, To formulate uniform norms of judicial media behavior, to remedy the influence of media supervision on fair trial and to regulate itself in the news industry.
