【摘要】：目的醫(yī)療糾紛人民調(diào)解是解決醫(yī)療糾紛的新途徑。河北省已在各地積極推行醫(yī)療糾紛人民調(diào)解機制，并取得了一定的成效。但是，由于種種原因，各地的醫(yī)療糾紛人民調(diào)解工作進展不一，已開展醫(yī)療糾紛人民調(diào)解工作的地方也存在一定的困難和問題。本文對國內(nèi)外醫(yī)療糾紛調(diào)解的經(jīng)驗進行了借鑒，并對河北省目前醫(yī)療糾紛人民調(diào)解中存在的問題進行了分析，提出了完善河北省醫(yī)療糾紛人民調(diào)解的建議和對策，期望能夠?qū)M一步改進和完善河北省醫(yī)療糾紛人民調(diào)解工作有所助益，促進醫(yī)療糾紛的合理、合法地解決，構(gòu)建和諧的醫(yī)患關(guān)系，保證醫(yī)療衛(wèi)生事業(yè)的健康、順利發(fā)展。 方法1文獻檢索法運用文獻檢索法，收集相關(guān)專家學(xué)者有關(guān)醫(yī)療糾紛調(diào)解的研究文獻、相關(guān)機構(gòu)和人員提供的的資料和信息。文獻的主要來源包括HealthSTAR等外文數(shù)據(jù)庫，CNKI、維普、方正、知網(wǎng)等中文數(shù)據(jù)庫，河北省司法廳、衛(wèi)生廳等網(wǎng)站、GOOGLE搜索網(wǎng)站等。通過文獻檢索法系統(tǒng)地掌握國內(nèi)外有關(guān)醫(yī)療調(diào)解的研究成果，了解醫(yī)療糾紛人民調(diào)解的研究現(xiàn)狀、取得的成績、成功的做法、存在的問題等。 2資料分析方法通過文獻檢索法和訪談法得到的資料多為定性資料。主要運用歸納、演繹、推論等方法，對定性資料進行整理和分析 3訪談法根據(jù)設(shè)計好的訪談提綱進行訪談。訪談對象為醫(yī)療糾紛人民調(diào)解委員會的調(diào)解員、醫(yī)療機構(gòu)負責(zé)醫(yī)療糾紛處理的工作人員。訪談內(nèi)容主要為醫(yī)療糾紛人民調(diào)解與其他解決醫(yī)療糾紛的方式相比具有的優(yōu)勢、目前醫(yī)療糾紛人民調(diào)解機制存在的主要問題、對完善醫(yī)療糾紛人民調(diào)解的建議等。結(jié)果1河北省面臨著較為嚴重的醫(yī)患關(guān)系問題，許多醫(yī)院深受醫(yī)療糾紛的困擾，希望能夠依法解決醫(yī)療糾紛，醫(yī)療糾紛人民調(diào)解是一種較好的方式。 2河北省重視醫(yī)療糾紛人民工作的開展，政府積極支持、督促各地建立醫(yī)療糾紛人民調(diào)解委員會，在辦公場所、經(jīng)費、人員等方面給予幫助。但醫(yī)療糾紛人民調(diào)解工作總體落后，且各地發(fā)展不平衡。 3河北省醫(yī)療糾紛人民調(diào)解工作的主要問題有：許多地方組建醫(yī)療糾紛人民調(diào)解委員會滯后于司法部、衛(wèi)計委等部委的要求；醫(yī)療糾紛人民調(diào)解委員會調(diào)解的糾紛數(shù)量不多，尚未成為醫(yī)療糾紛解決的主渠道；調(diào)解員素質(zhì)有待提高等。結(jié)論1醫(yī)療糾紛人民調(diào)解以其經(jīng)濟性、便捷性、民間性等特點，在解決醫(yī)療糾紛、化解醫(yī)患矛盾中有其突出的優(yōu)勢，應(yīng)當(dāng)大力推廣。 2針對河北省醫(yī)療糾紛人民調(diào)解工作中存在的問題，本研究提出了相應(yīng)的完善策略和措施：加強政府在醫(yī)療糾紛人民調(diào)解機制建設(shè)中的作用；建立健全醫(yī)療糾紛人民調(diào)解的保障機制；加強醫(yī)療糾紛人民調(diào)解的宣傳；加強醫(yī)療糾紛人民調(diào)解員隊伍建設(shè)；規(guī)范醫(yī)療糾紛人民調(diào)解委員會的調(diào)解活動；完善醫(yī)療責(zé)任保險制度；做好醫(yī)療糾紛人民調(diào)解與司法程序的銜接。
[Abstract]:The purpose of medical dispute mediation is a new way to solve medical disputes. Hebei province has in all localities to actively promote people's mediation mechanism of medical disputes, and achieved certain results. However, due to various reasons, the people's medical dispute mediation work around the progress is not the same, has carried out medical dispute mediation work where there are difficulties and some problems. Based on domestic and foreign medical dispute mediation experience for reference, and the present Hebei province people's mediation of medical dispute in the analysis of the existing problems, puts forward suggestions and Countermeasures to improve the medical disputes in Hebei province people's mediation, is expected to be helpful for further improvement and perfection of Hebei province people's mediation of medical dispute work, promote the medical disputes reasonably and legally solve, build a harmonious doctor-patient relationship, to ensure the health of healthy, smooth development.
1 methods of literature retrieval method using literature retrieval method, collect the relevant experts and scholars about the medical dispute mediation research literature, relevant institutions and personnel to provide data and information. To grasp the domestic and foreign research achievements about medical mediation through the method of literature retrieval, to understand the status of research on medical dispute mediation, the achievements of successful practices, existing problems and so on.
2, data obtained by literature search and interview are mostly qualitative data. The methods of induction, deduction and inference are used to collate and analyze qualitative data.

The interview objects are mediators of people's medical dispute mediation committee, medical institutions responsible for staff to deal with medical disputes. The main content of interview for the people's medical dispute mediation has advantages compared with other medical disputes, the main problems of people's mediation mechanism of medical disputes at present.
