【摘要】：審判權(quán)的本質(zhì)是一種判斷權(quán)。審判權(quán)的運行是整個司法工作的關(guān)鍵領(lǐng)域和核心,司法功能的發(fā)揮必須通過審判權(quán)的運行來實現(xiàn),而審判權(quán)的運行是否遵循其固有規(guī)律,會直接影響裁判的法律效果、社會效果和政治效果的好壞,更是關(guān)系到司法公信力和司法權(quán)威性的高低。近些年出現(xiàn)的司法公信力不高,司法權(quán)威缺失等現(xiàn)象,從某種程度上反映出審判權(quán)尚未能完全依照其規(guī)運行,審判權(quán)的運行出了問題,造成審判權(quán)運行的結(jié)果不盡如人意。本文分析了審判權(quán)運行的一般規(guī)律,并在此基礎(chǔ)上,針對我國審判權(quán)運行中存在的審判權(quán)地方化、行政化嚴重的問題,提出健全審判權(quán)運行規(guī)律的八項具體舉措。
[Abstract]:The essence of judicial power is a kind of judgment power. The operation of judicial power is the key field and core of the whole judicial work. The exertion of judicial function must be realized through the operation of judicial power, and whether the operation of judicial power follows its inherent law, It will directly affect the legal effect of the judge, the quality of the social effect and the political effect, but also relates to the judicial credibility and judicial authority. In recent years, the judicial credibility is not high, the judicial authority is lacking, and so on. To a certain extent, it reflects that the judicial power has not been fully operated in accordance with its rules, and the operation of the judicial power has gone wrong, resulting in unsatisfactory results of the operation of the judicial power. This paper analyzes the general law of the operation of the judicial power, and on this basis, In view of the serious problems of localization and administration of judicial power in the operation of judicial power in our country, eight concrete measures to perfect the running law of judicial power are put forward.
