【摘要】：當(dāng)前，在構(gòu)建社會(huì)主義和諧社會(huì)的總體背景下，踐行科學(xué)發(fā)展觀，，實(shí)現(xiàn)社會(huì)各個(gè)領(lǐng)域的和諧與科學(xué)發(fā)展成為現(xiàn)階段各部門(mén)單位的重要任務(wù)。監(jiān)獄因其特殊性擁有著極強(qiáng)的社會(huì)關(guān)注度，作為國(guó)家暴力機(jī)關(guān)，切實(shí)做到依法治監(jiān)、文明執(zhí)法、實(shí)現(xiàn)監(jiān)內(nèi)和諧、促進(jìn)社會(huì)穩(wěn)定成為了現(xiàn)階段監(jiān)獄工作的核心目標(biāo)。如何以科學(xué)發(fā)展觀為指導(dǎo)，建立和完善監(jiān)獄管理制度，服務(wù)于構(gòu)建和諧社會(huì)的大局，成為了所有監(jiān)獄工作者和社會(huì)共同面臨的考題。在本文中，筆者查閱相關(guān)法律規(guī)定、書(shū)籍報(bào)刊、文章資料和網(wǎng)絡(luò)資源，結(jié)合目前的監(jiān)獄管理工作的實(shí)踐，在總結(jié)了我國(guó)監(jiān)獄的發(fā)展歷程、國(guó)際監(jiān)獄發(fā)展趨勢(shì)及監(jiān)獄工作相關(guān)簡(jiǎn)介的基礎(chǔ)之上，概括我國(guó)監(jiān)獄管理制度的現(xiàn)狀，指出了發(fā)展過(guò)程中存在的問(wèn)題并分析內(nèi)在原因，有針對(duì)性地提出解決的對(duì)策和完善的建議。希望能夠?qū)ΡO(jiān)獄管理制度的完善、獄內(nèi)的和諧和社會(huì)的穩(wěn)定提供有積極意義的參考。筆者通過(guò)理論聯(lián)系實(shí)踐，提出了兩處新見(jiàn)解。第一，從構(gòu)建社會(huì)主義和諧社會(huì)的角度對(duì)于監(jiān)獄人民警察和服刑人員的權(quán)利保障提出新的思考。在監(jiān)獄人民警察隊(duì)伍建設(shè)方面，不單單只從監(jiān)獄人民警察的標(biāo)準(zhǔn)、職能、義務(wù)等要求方面探討，而是從以人為本、從優(yōu)待警的角度，將監(jiān)獄人民警察視為普普通通的社會(huì)一員、平平凡凡的一個(gè)勞動(dòng)者來(lái)研究其應(yīng)享有的權(quán)利和待遇；在監(jiān)獄服刑人員權(quán)利保障方面，在強(qiáng)調(diào)保障服刑人員合法權(quán)利的同時(shí)，也提出了關(guān)于服刑人員過(guò)度維權(quán)行為的預(yù)防和治理。以上兩方面觀點(diǎn)，都是從構(gòu)建和諧社會(huì)的角度出發(fā)來(lái)思考問(wèn)題，對(duì)于監(jiān)獄人民警察，是監(jiān)獄工作的主力軍，監(jiān)獄工作蓬勃發(fā)展離不開(kāi)監(jiān)獄人民警察的付出和奉獻(xiàn)，因此在從嚴(yán)治警的同時(shí)強(qiáng)調(diào)從優(yōu)待警對(duì)于監(jiān)獄事業(yè)的穩(wěn)定發(fā)展是必不可少的；對(duì)于服刑人員權(quán)利，合法保護(hù)是勢(shì)在必行的，但是對(duì)于過(guò)度維權(quán)行為的依法打擊也是毫不留情的，這將有利于監(jiān)獄機(jī)關(guān)和干警監(jiān)管工作的順利開(kāi)展、有利于歪風(fēng)邪氣的打擊消滅、有利于受害者及家屬權(quán)益的保障、有利于社會(huì)的和諧穩(wěn)定。第二，對(duì)于建國(guó)以來(lái)我國(guó)監(jiān)獄工作的發(fā)展進(jìn)程的階段性劃分提出新的概念。將學(xué)術(shù)上廣泛認(rèn)同的五個(gè)階段重新劃分，將第五階段又細(xì)化成為兩個(gè)獨(dú)立階段，針對(duì)新時(shí)期的新情況，提出了改革開(kāi)放成熟到一定程度之后對(duì)于我國(guó)監(jiān)獄管理制度發(fā)展產(chǎn)生的影響，據(jù)此劃分出了第六階段——2002年至今的突破瓶頸階段，這一觀點(diǎn)是筆者通過(guò)總結(jié)建國(guó)以來(lái)我國(guó)監(jiān)獄管理制度發(fā)展歷程、并結(jié)合目前監(jiān)獄管理工作發(fā)展現(xiàn)狀而提出的創(chuàng)造性成果。
[Abstract]:At present, under the overall background of building a harmonious socialist society, we should practice the scientific concept of development, The realization of harmony and scientific development in various fields of society has become an important task for various departments and units at this stage. Because of its particularity, prisons have a strong degree of social concern. As an organ of state violence, they can effectively manage the prison according to law and enforce the law in a civilized manner. Realizing the harmony within prison and promoting social stability has become the core goal of prison work at the present stage. How to establish and perfect prison management system under the guidance of scientific development view and serve the overall situation of constructing harmonious society, In this paper, I refer to the relevant laws and regulations, books, newspapers, articles, materials and network resources, combined with the current practice of prison management, On the basis of summarizing the development course of our country's prison, the international prison development trend and the brief introduction of prison work, this paper generalizes the present situation of our country's prison management system, points out the problems existing in the process of development, and analyzes the internal reasons. It is hoped that it can provide a positive reference for the improvement of prison management system, the harmony in prison and the stability of society. This paper puts forward two new opinions. First, from the perspective of building a harmonious socialist society, it puts forward new thoughts on the protection of the rights of the prison people's police and the prisoners. In the aspect of the construction of the prison people's police force, Not only from the standards, functions, obligations and other aspects of the prison people's police requirements, but from the people-oriented, from the perspective of preferential treatment of the police, the prison people's police are regarded as ordinary members of society. An ordinary worker studies the rights and treatment to which he or she should be entitled; in the context of the protection of the rights of prison inmates, emphasis is placed on the protection of the legal rights of prisoners, It also puts forward the prevention and management of excessive rights safeguarding behavior of prisoners. The above two viewpoints are considered from the point of view of building a harmonious society. For the prison people's police, they are the main force in prison work. The vigorous development of the prison work cannot be separated from the dedication and dedication of the prison people's police. Therefore, it is essential for the stable development of the prison cause to treat the police in a preferential manner while strictly managing the police; and for the rights of the prisoners, Legal protection is imperative, but the legal crackdown on excessive rights protection is also merciless. This will be conducive to the smooth development of the supervision work of the prison authorities and the police, and to the elimination of evil tendencies. It is beneficial to the protection of the rights and interests of the victims and their families, and to the harmony and stability of the society. Secondly, a new concept is put forward for the phased division of the development process of the prison work in China since the founding of the people's Republic of China. The 5th stage is further refined into two independent stages. In view of the new situation in the new period, the influence of the reform and opening up to a certain extent on the development of China's prison management system is put forward. Based on this, the author divides the period of 6th to 2002 to break through the bottleneck stage, which is a creative achievement put forward by the author through summing up the development course of the prison management system since the founding of the people's Republic of China and combining the present situation of the prison management work.
