【摘要】：我國(guó)人民調(diào)解制度不僅契合了中華民族所推崇的“和”之理念還以其解決糾紛速度快、靈活性強(qiáng)的特點(diǎn)而廣受贊譽(yù)。人民調(diào)解協(xié)議司法確認(rèn)制度作為我國(guó)人民調(diào)解工作體系中的一項(xiàng)重要制度,有利于維護(hù)人民調(diào)解的工作實(shí)效,推動(dòng)人民調(diào)解工作的發(fā)展與完善。作為一項(xiàng)新生制度,其不可避免的存在些許理論爭(zhēng)議、立法疏漏與運(yùn)行缺陷,因此本文以人民調(diào)解與司法確認(rèn)為整體切入點(diǎn),論述人民調(diào)解協(xié)議司法確認(rèn)制度。論文第一章探察人民調(diào)解協(xié)議司法確認(rèn)制度的發(fā)展歷程,司法確認(rèn)制度運(yùn)行的前提是需具備人民調(diào)解協(xié)議,所以研究人民調(diào)解協(xié)議司法確認(rèn)制度之前要理順我國(guó)人民調(diào)解制度的發(fā)展歷程,考察人民調(diào)解協(xié)議的效力變遷,引出司法確認(rèn)制度的立法沿革。第二章以當(dāng)前國(guó)內(nèi)研究領(lǐng)域普遍關(guān)注的司法確認(rèn)制度的性質(zhì)定位為主要內(nèi)容,探討司法確認(rèn)制度的性質(zhì),并分析其程序價(jià)值與實(shí)體價(jià)值。第三章通過(guò)實(shí)地訪談?wù){(diào)查、相關(guān)數(shù)據(jù)分析等方式歸納總結(jié)司法確認(rèn)制度在運(yùn)行與立法層面所存在的問(wèn)題與缺陷。第四章通過(guò)對(duì)域外相關(guān)制度的考察與借鑒,結(jié)合當(dāng)前司法確認(rèn)制度所在的問(wèn)題與缺陷,基于其性質(zhì)定位以及程序、實(shí)體價(jià)值,從運(yùn)行與立法兩方面論述完善我國(guó)人民調(diào)解協(xié)議司法確認(rèn)制度的構(gòu)想與建議。
[Abstract]:The people's mediation system in our country not only fit the respected Chinese nation "concept and" to resolve disputes speed, flexibility and wide acclaim. The people's mediation agreement judicial confirmation system as an important system in our country the people's mediation system, is conducive to safeguarding the people's mediation work effectiveness to promote the development and improvement of the people's mediation work. As a new system, there are some theoretical disputes inevitable, legislation and operation defects, so this paper to confirm the people's mediation and judicial as breakthrough point, the people's mediation agreement judicial confirmation system. The first chapter explore the people's mediation agreement judicial confirmation in the development process of the system the judicial confirmation system, the premise is to have the people's mediation agreement, so the study should straighten out our polls before the people's mediation agreement judicial confirmation system The development process of solution system, effectiveness analysis on the changes of people's mediation agreement, the judicial confirmation system leads to legislative history. The second chapter is to concern at home in the research field of the judicial confirmation system of nature as the main content, to explore the nature of the judicial confirmation system, and analyze the value of procedure and entity value. The third chapter through field interviews the investigation, data analysis methods such as summing up the judicial confirmation system problems and defects existing in the operation and the legislative level. The fourth chapter through the investigation and reference of foreign related system, combined with the current judicial confirmation system problems and defects of the entity, its nature and positioning procedures, based on the value, from the two aspects of operation and legislative discussion perfecting the people's mediation agreement judicial confirmation and suggestion system conception.
