【摘要】：未成年人刑事檢察制度作為我國未成年人司法制度中不可或缺的組成部分,雖然在一定程度上已經(jīng)構(gòu)建,但是相關(guān)的研究仍舊停留在審判階段,也無法滿足當(dāng)前我國未成年人司法制度發(fā)展的需求。本文主要是結(jié)合相關(guān)理論及案例,對我國當(dāng)前的未成年刑事檢察制度的發(fā)展背景、現(xiàn)狀、存在的問題進(jìn)行研究,結(jié)合未成年人身心特點(diǎn),探討未成年人刑事檢察制度發(fā)展的方向和前景,以期探索出一條同時能夠嚴(yán)格執(zhí)行打擊犯罪,保護(hù)國家利益和在具體的未成年刑事案件中兼顧到未成年人利益的符合時代發(fā)展要求的未成年人刑事檢察制度。 具體說來,我國未成年人刑事檢察制度存在的問題主要有以下一些方面的體現(xiàn)：其一未成年人刑事案件處理專業(yè)人才缺失。一些相對優(yōu)秀的法官沒有專門的從事少年刑事案件審理,我國少年法庭名不副實(shí)。另一方面,缺失刑事審查專業(yè)知識的人才。其二,沒有嚴(yán)格貫徹迅速簡易的未成年人刑事案件處理原則,不能及時的對未成年人犯罪進(jìn)行教育、矯治和挽救,就很可能使其犯罪心理及犯罪行為定型,也就會大大的提升這些罪犯重新犯罪的幾率。其三,社會調(diào)查報告等制度流于形式,未成年人庭審教育沒有針對性、缺乏規(guī)范性、系統(tǒng)性和科學(xué)性,庭前延伸教育也是沒有按照程序?qū)崿F(xiàn),時斷時續(xù),沒有真正發(fā)揮出調(diào)查報告的作用。其四,未成年人不起訴制度不健全,我國現(xiàn)行的刑事檢察制度中,并沒有對不起訴運(yùn)行程序作出具體的規(guī)定,在實(shí)踐中也會產(chǎn)生矛盾和沖突。 □針對當(dāng)前存在的問題,文章探討了解決存在問題的策略,首先,需要全面提升檢察人員的專業(yè)素質(zhì),加強(qiáng)專門從事未成年人檢察工作檢察官的遴選,從源頭把好質(zhì)量關(guān),另外也要加強(qiáng)素質(zhì)的培訓(xùn)。其次,檢察機(jī)關(guān)應(yīng)該在司法實(shí)務(wù)中加強(qiáng)對社會調(diào)查制度的執(zhí)行力度,加強(qiáng)創(chuàng)新,不斷的完善社會檢察制度。再次,我國應(yīng)該建立健全未成年人不起訴制度,構(gòu)建完善的未成年人不起訴制度體系。一是要適當(dāng)?shù)姆艑拰ξ闯赡晗鄬Σ黄鹪V的條件,二是要完善不起訴決定前的公開審查制度。此外,檢察機(jī)關(guān)必須切實(shí)的貫徹執(zhí)行和完善刑事檢察制度相關(guān)程序,推動建立健全辦理未成年人刑事案件配套工作體系和未成年人犯罪社會化幫教預(yù)防體系。最后,必須完善“審判后”的回訪幫教制度,更好地解決前科對未成年人罪犯將來學(xué)習(xí)、就業(yè)等方面的不利影響,避免前科帶來的負(fù)面影響,能夠平等的享有與其他正常人一樣的權(quán)利和機(jī)會,使其真正改過自新,回歸社會。
[Abstract]:As an indispensable part of the juvenile justice system in our country, the juvenile criminal procuratorial system has been constructed to a certain extent, but the related research is still in the trial stage. Also can not meet the needs of the development of juvenile justice system in China. This paper mainly combines the relevant theories and cases to study the development background, current situation and existing problems of the juvenile criminal procuratorial system in our country. Combining the physical and mental characteristics of minors, to explore the direction and prospects of the development of the juvenile criminal procuratorial system, with a view to exploring a rule that can be strictly enforced in the fight against crime at the same time, To protect the national interests and to take into account the interests of minors in specific minor criminal cases according with the requirements of the development of the times juvenile criminal prosecution system. Specifically, The problems existing in our juvenile criminal procuratorial system are mainly reflected in the following aspects: first, there is a lack of professional personnel in juvenile criminal case handling. Some relatively good judges do not specialize in juvenile criminal cases. On the other hand, talents who lack professional knowledge of criminal examination. Secondly, they have not strictly implemented the principles of handling juvenile criminal cases quickly and simply, and they cannot promptly educate minors on juvenile delinquency. Correction and rescue are likely to stereotype their criminal psychology and criminal behavior, which will greatly enhance the probability of reoffending these criminals. Third, social investigation reports and other systems are mere formality, and juvenile trial education has no pertinence. Lack of standardization, systematicness and scientificalness, extension education before court is also not realized according to the procedure, from time to time, and from time to time, it does not really play the role of investigation report. Fourth, the system of non-prosecution of minors is not perfect. In the present criminal procuratorial system of our country, there is no specific stipulation on the procedure of non-prosecution, and there will be contradictions and conflicts in practice. In view of the existing problems, the article discusses the strategies for solving the existing problems. First, it is necessary to comprehensively upgrade the professional quality of procuratorial personnel, strengthen the selection of procurators specializing in juvenile procuratorial work, and control the quality of procurators from the source. In addition, we should also strengthen quality training. Secondly, procuratorial organs should strengthen the implementation of the social investigation system in judicial practice, strengthen innovation, and constantly improve the social procuratorial system. Again, Our country should establish and improve the system of non-prosecution of minors and the system of non-prosecution of minors. First, we should relax the conditions of relatively non-prosecution of minors. Second, it is necessary to improve the public review system before the decision to not prosecute. In addition, the procuratorial organs must effectively implement and improve the relevant procedures of the criminal procuratorial system. To promote the establishment and improvement of the supporting work system for handling juvenile criminal cases and the system for socializing the help and education of juvenile delinquents. Finally, we must improve the "post-trial" system of return visits and education. To better address the adverse effects of previous convictions on the future study and employment of juvenile offenders, to avoid the negative effects of previous convictions, to enjoy the same rights and opportunities as other normal persons on an equal footing, and to make them truly rehabilitate. Return to society.
