【摘要】：法院與法院之間差異甚大,在改革過程中各地法院應(yīng)享有一定的自主權(quán),以使它們能建立與本院"院情"相適應(yīng)的法官助理制度。實(shí)踐中法官助理的職責(zé)范圍并非決定于改革文件之規(guī)定,而是由法院的案件負(fù)擔(dān)、法官的素質(zhì)與法官助理的數(shù)量及能力等多種因素決定。關(guān)于法官助理的出路,職業(yè)化是一個值得努力的發(fā)展方向,不應(yīng)將晉升法官作為法官助理的職業(yè)前景。法官助理改革能否成功,與它作為一個職業(yè)對法學(xué)院畢業(yè)生究竟有多大吸引力關(guān)系甚巨。法官助理改革實(shí)際上是法官員額制改革的次改革。員額制改革進(jìn)程的快慢、改革目標(biāo)的達(dá)成狀況,在很大程度上左右著法官助理改革的命運(yùn)。而員額制改革的成敗則仰賴于改革者的決心與魄力。
[Abstract]:There are great differences between the courts and the courts, and the local courts should enjoy a certain degree of autonomy in the process of reform. In practice, the scope of the duties of the assistant judges is not determined by the provisions of the reform documents, but by the court case burden. The quality of judges and the number and ability of judges' assistants are determined by many factors. On the way out of judges' assistants, professionalization is a development direction worth striving for. There should be no career prospects for the promotion of judges as assistants and the success of the reform of paralegals. It has much to do with how attractive it is to law school graduates as a profession. The reform of paralegals of judges is actually a sub-reform of the reform of the post system of judges, and the pace of the reform of the post system. To a great extent, the achievement of the reform objectives determines the fate of the reform of the assistant judges, while the success or failure of the post system reform depends on the determination and drive of the reformers.
