【摘要】：職務(wù)犯罪是當(dāng)今各個(gè)國(guó)家和地區(qū)都面臨的嚴(yán)重犯罪,在我國(guó),職務(wù)犯罪也不容小覷,不僅呈現(xiàn)出新的發(fā)展趨勢(shì),且其社會(huì)危害也日趨嚴(yán)重,因此如何遏制職務(wù)犯罪是當(dāng)務(wù)之急。然而,傳統(tǒng)的應(yīng)對(duì)之策成效有限,必須在現(xiàn)有體制范圍之內(nèi)尋求新的途徑,以適應(yīng)反職務(wù)犯罪新形勢(shì)的需要,檢察機(jī)關(guān)職務(wù)犯罪偵防控一體化機(jī)制即是一可行之策。 筆者從檢察機(jī)關(guān)職務(wù)犯罪偵防控一體化機(jī)制的內(nèi)涵入手,具體闡述了檢察機(jī)關(guān)職務(wù)犯罪偵查、預(yù)防和控制的含義,然后分別從三方面來(lái)論證該機(jī)制的可行性和必要性。筆者通過(guò)對(duì)信息共享制度、信息預(yù)警制度、檢察建議等各個(gè)具體制度的構(gòu)建來(lái)闡述對(duì)整個(gè)機(jī)制的設(shè)想,并將檢察機(jī)關(guān)的偵查部門(mén)、預(yù)防部門(mén)和控申部門(mén)在具體的反職務(wù)犯罪工作中強(qiáng)調(diào)其互相配合,實(shí)現(xiàn)工作聯(lián)動(dòng),發(fā)揮其最大作用,其次還通過(guò)各方面的保障措施來(lái)促使該機(jī)制得到有效實(shí)施。 本文的創(chuàng)新點(diǎn)有：1、綜合討論檢察機(jī)關(guān)職務(wù)犯罪偵查、預(yù)防和控制職能的發(fā)揮；2、探索檢察機(jī)關(guān)內(nèi)部偵查、預(yù)防和控申部門(mén)之間在犯職務(wù)犯罪工作上的工作聯(lián)動(dòng)。
[Abstract]:Duty crime is a serious crime faced by every country and region nowadays. In our country, the duty crime can not be underestimated. It not only presents a new trend of development, but also its social harm is becoming more and more serious. Therefore, how to contain the duty crime is an urgent matter. However, the traditional countermeasures are limited, we must find new ways within the scope of the existing system to meet the needs of the new situation of anti-duty crime. The integrated mechanism of investigation, prevention and control of procuratorial organs' duty crime is a feasible strategy. The author starts with the connotation of the integrative mechanism of investigation, prevention and control of procuratorial organ's duty crime, and expounds the meaning of the investigation, prevention and control of the procuratorial organ's duty crime. Then from three aspects to demonstrate the feasibility and necessity of the mechanism. The author through the information sharing system, information early warning system, procuratorial suggestions and other specific systems to elaborate on the entire system of ideas. And the investigation department of the procuratorial organ, the prevention department and the control department emphasize their mutual cooperation in the specific anti-duty crime work, realize the linkage of the work, and give play to its maximum role. Secondly, the mechanism can be effectively implemented through various safeguards. The innovation point of this article is: 1, discuss comprehensively the function of investigation, prevention and control of procuratorial organ duty crime; 2. To explore the linkage between the internal investigation, prevention and control of crimes committed by procuratorial organs.
