【摘要】： 內(nèi)容摘要：中國(guó)古代的統(tǒng)治者已經(jīng)認(rèn)識(shí)到以法律手段保護(hù)社會(huì)公共安全和秩序的重要性,并在立法中具體規(guī)定了在當(dāng)時(shí)的社會(huì)條件下可能出現(xiàn)的各種危害公共安全犯罪的行為。本文將在考察中國(guó)歷代法律中有關(guān)危害公共安全犯罪的基礎(chǔ)上,重點(diǎn)分析唐律中的危害公共安全犯罪,進(jìn)而將其與我國(guó)當(dāng)代刑法中的危害公共安全犯罪進(jìn)行比較,找出其中值得今日刑法借鑒之處。以此為研究的出發(fā)點(diǎn),本文包括相互關(guān)聯(lián)的五大部分：首先界定危害公共安全犯罪的概念；其次對(duì)中國(guó)歷代法律中危害公共安全犯罪的沿革進(jìn)行考察；再次是歸納整理唐律中的危害公共安全犯罪,并在與當(dāng)代刑法中危害公共安全犯罪比較的基礎(chǔ)上分析其特征；又次是對(duì)唐代危害公共安全罪實(shí)施情況的考察；最后是指出唐律中危害公共安全犯罪的規(guī)定對(duì)我國(guó)當(dāng)代刑法修改的借鑒意義。
[Abstract]:Abstract: the rulers of ancient China have realized the importance of protecting social public safety and order by legal means, and specified in the legislation all kinds of crimes against public safety that may occur under the social conditions at that time. On the basis of investigating the crimes against public safety in the laws of previous dynasties in China, this paper will focus on the analysis of the crimes against public safety in the law of Tang Dynasty, and then compare it with the crimes against public safety in the contemporary criminal law of our country. Find out what is worth learning from today's criminal law. Taking this as the starting point of the study, this paper includes five interrelated parts: first, define the concept of crimes against public safety; secondly, investigate the evolution of crimes against public safety in the laws of previous dynasties in China; Thirdly, it summarizes and arranges the crimes against public safety in Tang law, and analyzes its characteristics on the basis of comparing with the crimes against public safety in contemporary criminal law, and also investigates the implementation of crimes against public safety in Tang Dynasty. Finally, it points out that the provisions of Tang law on crimes against public safety are of reference significance to the revision of contemporary criminal law in our country.
