【摘要】： 法律語言學(forensic linguistics)是研究法律語言的交叉學科,是語言學和法學兩門學科相結合的產物�！胺烧Z言學研究不是純粹的語言學研究,也不是純粹的法律研究,而是語言學框架下的法律語言研究�！狈尚g語是法律語言詞匯的核心。法律術語研究是法律語言研究的重要領域。本文對法律術語的界說、法律術語類型論、法律術語特征論、法律術語超常規(guī)的語言現象、法律術語結構論、等幾個方面進行了討論。 法律術語的界定有廣義和狹義之別。此外,我們從法律術語的意義、功能、來源和內部形式等方面對法律術語進行了詳盡的分類。法律術語的特征是由法律語言的特殊應用領域和特定的交際對象及交際功能所決定的,體現了法律的強制性、權威性和嚴肅性的基本特點。法律術語具有結構上的凝合性和意義上的法定性、單義性與準確性的特征。法律術語的研究對于立法、司法、執(zhí)法、普法活動的有效開展,對于實現法律的公平、公正都具有十分重要的意義。
[Abstract]:Legal linguistics (forensic linguistics) is a cross-disciplinary study of legal language and a combination of linguistics and law. "legal linguistics is not purely linguistic, nor is it purely legal, but legal language within the framework of linguistics." Legal terminology is the core of legal language vocabulary. The study of legal terminology is an important field in the study of legal language. This paper discusses the definition of legal terms, the typology of legal terms, the characteristic theory of legal terms, the supernormal linguistic phenomena of legal terms, the structure of legal terms, and so on. Legal terms are defined in a broad sense and in a narrow sense. In addition, the meaning, function, source and internal form of legal terms are classified in detail. The characteristics of legal terms are determined by the special application fields of legal language, specific communicative objects and communicative functions, and embody the basic characteristics of law's compulsion, authority and seriousness. Legal terms have the characteristics of structural condense and legal, simplistic and accurate. The research of legal terminology is of great significance for the effective development of legislation, judicature, law enforcement and popularization of law, as well as for the realization of justice and fairness of law.
