中國(guó)古代復(fù)仇制度考論中文摘要 I 中國(guó)古代復(fù)仇制度考論中文摘要復(fù)仇現(xiàn)象自遠(yuǎn)古已有之,并在我國(guó)漫長(zhǎng)的古代時(shí)期乃至到今天仍存在著,這其中有其產(chǎn)生和存在的歷史條件和思想基礎(chǔ),但復(fù)仇真正發(fā)展成較為完備的制度卻是直到西周了。之后的春秋戰(zhàn)國(guó)時(shí)期,百家爭(zhēng)鳴,各家對(duì)復(fù)仇制度更是產(chǎn)生了不同的看法, 并引起了激烈的爭(zhēng)論。儒家從“禮”出發(fā),主張應(yīng)當(dāng)復(fù)仇,而法家卻從國(guó)家獨(dú)占司法權(quán)力的角度出發(fā),堅(jiān)持反對(duì)私人復(fù)仇。漢武帝“獨(dú)尊儒術(shù)”后,儒學(xué)成為“官學(xué)”, 由于儒家所倡導(dǎo)的倫理文化是“重義”、“重孝”,因而復(fù)仇之風(fēng)在民間大盛。然而在國(guó)家法律制度上,卻有時(shí)嚴(yán)禁,有時(shí)放任,有時(shí)限制,與儒家思想并不完全一致,導(dǎo)致“情禮法沖突”時(shí)有發(fā)生。對(duì)復(fù)仇制度進(jìn)行研究,既可加深對(duì)中國(guó)古代法制發(fā)展的認(rèn)識(shí),并挖掘出其在當(dāng)代存在的積極意義,也可從中尋找適應(yīng)當(dāng)下的復(fù)仇案件的處理機(jī)制,有利于構(gòu)建安定祥和的社會(huì)。關(guān)鍵詞:復(fù)仇制度;情禮法沖突;當(dāng)代意義作者:何雅婷指導(dǎo)教師:高積順教授 Abstract A exhaustive research in the System of Revenge in Traditional China II A exhaustive research in the System of Revenge in Traditional China Abstract The act of revenge appeared in ancient china and continued to exist without any prohibited sign.It must be having its historical reasons and ideological foundation.Until the Western Zhou Dynasty,it es a system.In Spring and Autumn Period,each school of thought has a different view of the system of revenge.Confucian praised highly the revenge because of the filiality and righteousness.However,Legalism thought the revenge must be limited or prohibited.Facing the conflict between affection,rite and law, one can find different ways to solve this problem for each person in every dynasty.To study the system of revenge,we can find the positive significance and the handling mechanism in the contemporary.
