【摘要】：文章主要的寫(xiě)作目的是為了探討傳統(tǒng)法律文化中所蘊(yùn)含的可供現(xiàn)代借鑒的成果。本文以傳統(tǒng)法律文化中的核心儒家為切入點(diǎn),通過(guò)對(duì)儒家治國(guó)方略,家庭倫理,天道觀念,立法觀念,司法觀念問(wèn)題的探討,通過(guò)對(duì)儒家學(xué)者主要法律思想的梳理,能更好的將儒家法律思想中的一些精華擷取出來(lái),為現(xiàn)在和諧社會(huì)的構(gòu)建提供支持。 本文分為三個(gè)部分： 第一部分,引言部分介紹了選題意義背景,以及一些研究現(xiàn)狀。 第二部分,主要概括介紹了儒家法律思想,同時(shí)對(duì)先秦儒家的幾個(gè)人物進(jìn)行重點(diǎn)介紹梳理。來(lái)闡明儒家的“仁者愛(ài)人”“為政以德”“性善論”“民貴君輕”“暴君放伐”等等理論。通過(guò)這些儒家重點(diǎn)人物的介紹,能更好的說(shuō)明本文在后篇中對(duì)儒家思想的和諧理念的說(shuō)明。 第三部分,這是本文的核心內(nèi)容,主要從儒家所提倡的治國(guó)方略、天道觀念、家庭倫理觀念、立法司法觀念等等方面入手,在前滿(mǎn)梳理的基礎(chǔ)上,來(lái)集中闡明儒家法律思想中和諧精神的所在。 第四部分,分析了儒家法律思想在現(xiàn)代應(yīng)用的可行性,以及概括的說(shuō)明了從哪幾方面我們可以借鑒儒家法律思想中的優(yōu)秀理念。
[Abstract]:The main purpose of this paper is to explore the achievements that can be used for reference in the traditional legal culture. This article takes the core Confucianism in the traditional legal culture as the breakthrough point, through the discussion of the Confucian strategy of governing the country, family ethics, the idea of Heaven Tao, the concept of legislation, the concept of judicature, and combs the main legal thoughts of the Confucian scholars. To better extract some of the essence of Confucian legal thought, to provide support for the construction of a harmonious society. This paper is divided into three parts: the first part, the introduction introduces the meaning of the topic background, and some research status. The second part, mainly introduces the Confucian legal thought, at the same time carries on the introduction combing to the pre-Qin Confucianist several personages. To clarify the Confucian "benevolent lover", "to govern by virtue," the theory of good, "the people and noble gentleman light," tyrant, "and so on theory. Through the introduction of these key Confucianists, it can better explain the harmonious idea of Confucianism in the later part of this paper. The third part, this is the core content of this paper, mainly from the Confucian advocated by the principles of governing the country, the idea of Heaven, family ethics, legislative and judicial concepts and so on, on the basis of combing before the full. To clarify the Confucian legal ideology of the spirit of harmony. In the fourth part, the author analyzes the feasibility of the application of the Confucian legal thought in modern times, and explains from which aspects we can draw lessons from the outstanding ideas of the Confucian legal thought.
