【摘要】：美國的產(chǎn)品責(zé)任法立法早,發(fā)展完善。產(chǎn)品缺陷的標(biāo)準(zhǔn)都有詳細(xì)的劃分和規(guī)定。我國《產(chǎn)品質(zhì)量法》中第四十六條對產(chǎn)品缺陷的概念和相應(yīng)的標(biāo)準(zhǔn)也作了一些規(guī)定,其中把國家的強制標(biāo)準(zhǔn)和行業(yè)認(rèn)定標(biāo)準(zhǔn)作為對產(chǎn)品缺陷認(rèn)定的優(yōu)先考慮因素,這既具有合理的一面,也存在一定問題。本文通過探討美國的產(chǎn)品責(zé)任立法的合理性,希望對完善我國的產(chǎn)品立法有所啟示。
[Abstract]:The United States product liability law legislation is early, the development is perfect. The product defect standard has the detailed division and the stipulation. Article 46 of the Product quality Law of our country also makes some provisions on the concept of product defect and the corresponding standard, in which the national compulsory standard and the industry standard are regarded as the priority factors for the identification of product defect. This has a reasonable side, but also there are certain problems. This paper discusses the rationality of the product liability legislation in the United States, hoping to give some enlightenment to the improvement of the product legislation in our country.
