論英國土地保有關(guān)系對債作為財(cái)產(chǎn)所有權(quán)客體的影響

【摘要】：英國法上,財(cái)產(chǎn)所有權(quán)的客體不是有體物而是財(cái)產(chǎn)利益。英國法財(cái)產(chǎn)所有權(quán)客體的形成有其特定的歷史原因,土地保有關(guān)系的產(chǎn)生是英國法財(cái)產(chǎn)權(quán)客體定位為財(cái)產(chǎn)利益的根本原因,土地保有關(guān)系模式下的這種立法思想深深影響了英國所有權(quán)客體理論。在英國法上,任何具有獨(dú)占排他的財(cái)產(chǎn)利益均可以成為所有權(quán)的客體,因合同等原因而產(chǎn)生的債屬于債權(quán)人的財(cái)產(chǎn)利益,因此英國法將其作為所有權(quán)的客體。英國法明確區(qū)分因合同產(chǎn)生的債的所有權(quán)以及合同權(quán)利本身,英國法的債權(quán)的二分理論值得我國學(xué)界研究。
[Abstract]:In English law, the object of property ownership is not a substance but a property interest. There are specific historical reasons for the formation of the object of property ownership in English law, and the emergence of land tenure is the fundamental reason why the object of property right of English law is positioned as the benefit of property. This kind of legislative thought under the land tenure mode has deeply influenced the theory of the object of ownership in Britain. In English law, any property interest with exclusive ownership can be the object of ownership, and the debt arising from contract and other reasons belongs to the creditor's property interest, so English law regards it as the object of ownership. The English law clearly distinguishes the ownership of the debt arising from the contract and the contractual right itself. The dichotomy of the claims of English law is worthy of our academic research.
