儒家禮制與當代中國法治

【摘要】:"禮"是儒家文化中的核心概念之一,周公將祭祀之"禮"發(fā)展為維護宗法等級制度的行為規(guī)范以及國家治理的典章規(guī)定和禮節(jié)儀式,先秦儒家傳承周禮并加以改良和創(chuàng)新,形成了對中國傳統(tǒng)社會影響深重的儒家禮制。禮制體現(xiàn)了王權(quán)至上、宗法血緣、祖先崇拜等中國傳統(tǒng)文化的因素,具有"經(jīng)國家,定社稷,序民人,利后嗣"的強大社會功能。"仁"是儒家禮制的道德基礎(chǔ),"德主刑輔"、"為政以德"和"隆禮重法"構(gòu)成了儒家禮制的德法關(guān)系觀。當代中國的法治建設(shè)需要充分吸收儒家禮制傳統(tǒng)中的有益養(yǎng)分,強化法治的道德支撐、尊重民間習慣法、塑造權(quán)利與義務(wù)相統(tǒng)一的法治文化。
[Abstract]:"Li" is one of the core concepts in Confucian culture. Zhou Gong developed the ritual of sacrifice into the code of conduct of maintaining the patriarchal hierarchy system, as well as the regulations and rituals of state governance, and the pre-Qin Confucianism inherited, improved and innovated the rites of Zhou. Has formed the Confucian etiquette system which has the profound influence to the Chinese traditional society. The ritual system embodies the factors of Chinese traditional culture, such as Wang Quan's supremacy, patriarchal lineage, ancestor worship and so on. It has the powerful social function of "the state, the preface and the people, and the heirs". Benevolence is the moral basis of Confucian ritual system. "morality dominates punishment and auxiliary punishment", "to govern by virtue" and "to pay more attention to law" constitute the Confucian concept of morality and law relations. The construction of the rule of law in contemporary China needs to fully absorb the beneficial nutrients in the tradition of Confucian etiquette, strengthen the moral support of the rule of law, respect the folk customary law, and shape the culture of rule of law with the unity of rights and obligations.
