哈耶克進(jìn)化論理性主義法律觀探究

【摘要】：雖然受到歷史和時(shí)代的限制,哈耶克進(jìn)化論理性主義法律觀亦有其不可避免的局限性,但其對于當(dāng)下中國的法治建設(shè)乃至于中國的現(xiàn)代化進(jìn)程依舊具有重大的啟示意義。哈耶克進(jìn)化論理性主義法律觀可以追溯到哈耶克早期心理學(xué)的"關(guān)系論轉(zhuǎn)向"、經(jīng)濟(jì)學(xué)的"認(rèn)識論轉(zhuǎn)向"以及立基于古典自由主義傳統(tǒng)之上的"進(jìn)化論轉(zhuǎn)向"。哈耶克進(jìn)化論理性主義法律觀有三大知識基礎(chǔ):馬赫認(rèn)知心理學(xué)、奧地利經(jīng)濟(jì)學(xué)傳統(tǒng)和古典自由主義傳統(tǒng)。按"時(shí)間向度"和"邏輯向度",哈耶克進(jìn)化論理性主義法律觀的發(fā)展脈絡(luò),可分為五個(gè)階段:進(jìn)化論理性主義法律觀之前的哈耶克、進(jìn)化論理性主義法律觀的產(chǎn)生、進(jìn)化論理性主義法律觀的發(fā)展、進(jìn)化論理性主義法律觀的成熟、進(jìn)化論理性主義法律觀的深化。探討哈耶克進(jìn)化論理性主義法律觀建構(gòu)的內(nèi)在理路應(yīng)包含五個(gè)問題:分析哈耶克理論中法律的內(nèi)涵,理解哈耶克在法律生成與進(jìn)化方面的認(rèn)識,總結(jié)哈耶克正當(dāng)行為規(guī)則的正當(dāng)性檢測標(biāo)準(zhǔn),澄清哈耶克進(jìn)化理論的通常誤解,闡明進(jìn)化論與理性主義之于哈耶克的內(nèi)在一致性。哈耶克進(jìn)化論理性主義法律觀的根本目的,在于構(gòu)建"自由主義烏托邦"。
[Abstract]:Although Hayek's theory of rationalism has its inevitable limitations due to the limitation of history and times, it is still of great significance to the construction of the rule of law in China and even to the process of modernization in China. Hayek's evolutionary rationalism legal view can be traced back to Hayek's early psychology "relationship theory turn", economics "epistemological turn" and "evolution turn" based on the tradition of classical liberalism. Hayek's evolutionary rationalism has three knowledge bases: Mach cognitive psychology, Austrian economic tradition and classical liberalism tradition. According to the "time dimension" and "logical direction", the development of Hayek's theory of rationalism law can be divided into five stages: Hayek before the law view of evolution rationalism, the emergence of the legal view of evolution rationalism. The development of evolutionary rationalism, the maturity of evolutionary rationalism, and the deepening of evolutionary rationalism. There are five problems in the construction of Hayek's theory of law: the analysis of the connotation of law in Hayek's theory, the understanding of Hayek's understanding of the formation and evolution of law. This paper summarizes the legitimacy test standard of Hayek's proper behavior rules, clarifies the common misunderstandings of Hayek's evolution theory, and clarifies the inherent consistency between evolution and rationalism in Hayek. The fundamental purpose of Hayek's Evolutionism is to construct a liberal utopia.
