【摘要】：社會(huì)語(yǔ)境是介于社會(huì)需求事實(shí)與上層建筑之間的媒介場(chǎng)景,作為第三法域或是部門(mén)法的社會(huì)法也應(yīng)該有自己特殊的社會(huì)語(yǔ)境系統(tǒng)。當(dāng)代西方國(guó)家因社會(huì)內(nèi)部壓力對(duì)市民社會(huì)自由性和自利性的有限改造,促成了"律他、利他"的人民社會(huì)初級(jí)語(yǔ)境形成,體現(xiàn)出"協(xié)調(diào)市場(chǎng)競(jìng)爭(zhēng)與進(jìn)行社會(huì)保護(hù)"的政治觀(guān)念,西方國(guó)家的社會(huì)法是對(duì)該政治觀(guān)念的法制反映。"以人為本、謀求社會(huì)成員共同幸福"是中國(guó)特色社會(huì)主義人民社會(huì)語(yǔ)境的政治觀(guān)念,中國(guó)的社會(huì)法建設(shè)除應(yīng)具有"協(xié)調(diào)市場(chǎng)競(jìng)爭(zhēng)與進(jìn)行社會(huì)保護(hù)"之相同經(jīng)濟(jì)、社會(huì)功效外,還具有制度自覺(jué)的政治功效。人民社會(huì)不同層次的政治觀(guān)念決定了兩種不同的社會(huì)法立法目標(biāo)與任務(wù)和其在法律體系中不同的實(shí)體地位。
[Abstract]:Social context is a media scene between the fact of social needs and the superstructure. As a third jurisdiction or branch of law, social law should also have its own special social context system. The limited transformation of civil society freedom and self-interest in contemporary western countries due to the internal pressure of the society has contributed to the formation of the people's primary social context of "law and altruism", which embodies the political concept of "coordinating market competition and carrying out social protection". The social law of the western countries is a reflection of the legal system of this political idea. " "People-oriented, seeking the common happiness of social members" is the political concept in the social context of the socialist people with Chinese characteristics. The construction of social law in China should have the same economic and social effects as "coordinating market competition and social protection". It also has the political effect of system consciousness. The political concepts at different levels of the people's society determine two different legislative objectives and tasks of social law and their different substantive status in the legal system.
