【摘要】： 信托源于英國的衡平法,是一種特殊的財產(chǎn)管理制度。在養(yǎng)老金管理過程中引入信托機(jī)制有助于養(yǎng)老金的保值與增值。養(yǎng)老金信托就是把累積起來的養(yǎng)老金用信托的方式進(jìn)行管理,并使之保值和增值的制度。養(yǎng)老金信托具有權(quán)益分離性、財產(chǎn)獨(dú)立性、社會公益性、規(guī)劃長期性、理財專業(yè)性等特征。目前,養(yǎng)老金信托已成為一種被許多國家廣泛運(yùn)用的養(yǎng)老金管理形式。英國的養(yǎng)老金信托較為發(fā)達(dá),其養(yǎng)老金信托立法也比較完備,并形成了一個較為完備的法律規(guī)制體系,為英國養(yǎng)老金信托的健康發(fā)展提供了有力的法律支持。 我國目前的養(yǎng)老金制度正處于一個重要的發(fā)展時期,統(tǒng)賬結(jié)合的養(yǎng)老金結(jié)構(gòu)模式要求養(yǎng)老金能保值和增值,而將其運(yùn)用信托的機(jī)制進(jìn)行管理是一個可行的選擇。在這方面,英國養(yǎng)老金信托的法律規(guī)制方式給予我國以許多啟示,我國應(yīng)選擇正確的養(yǎng)老金信托監(jiān)管模式,加強(qiáng)對養(yǎng)老金信托投資的監(jiān)管立法,完善我國養(yǎng)老金投資信托的監(jiān)管主體,強(qiáng)化對養(yǎng)老金托管機(jī)構(gòu)與中介機(jī)構(gòu)的監(jiān)管,此外,還應(yīng)健全我國的審計監(jiān)督和社會監(jiān)督。
[Abstract]:Trust originates from the equity of England and is a special property management system. The introduction of trust mechanism in the process of pension management helps to preserve and increase the value of pension. Pension trust is a system in which the accumulated pension is managed by trust and maintained and added value. Pension trust is characterized by separation of rights and interests, independence of property, public welfare, long-term planning and professional financial management. At present, pension trust has become a widely used pension management form in many countries. The pension trust in Britain is more developed, its pension trust legislation is also relatively complete, and formed a relatively complete legal regulation system, which provides a strong legal support for the healthy development of the British pension trust. The current pension system in China is in an important period of development. The pension structure model of the combination of general account and accounting requires that the pension can maintain and increase in value, and it is a feasible choice to use the trust mechanism to manage it. In this respect, the legal regulation of British pension trust gives us a lot of enlightenment. We should choose the correct pension trust supervision mode and strengthen the supervision legislation of pension trust investment. In addition, we should perfect the supervision body of pension investment trust and strengthen the supervision of pension trusteeship institution and intermediary institution. In addition, we should also perfect the audit supervision and social supervision in our country.
