道德與法律關(guān)系的時代建構(gòu):道德法律化初探

【摘要】:在生活日益多元的時代里,隨著社會意識的多樣化發(fā)展,民眾對道德及法律的理解也呈多元化的發(fā)展態(tài)勢。一方面社會的容忍度在不斷增加,另一方面人們對道德與法律之間關(guān)系的理解變得更為復(fù)雜,有些人認(rèn)為道德與法律之間不存在必然的聯(lián)系,法律不受道德的影響可以獨(dú)立適用;有些人則認(rèn)為道德與法律之間雖有聯(lián)系但矛盾重重,關(guān)系錯綜復(fù)雜。面對當(dāng)前的社會發(fā)展現(xiàn)狀,本文試圖以正確分析道德與法律之間的關(guān)系作為理論依據(jù),初步探討道德法律化在多元社會下可能存在的貢獻(xiàn)。目前國內(nèi)不少學(xué)者對道德法律化的看法褒貶不一,我們有必要針對當(dāng)前我國所處的特殊轉(zhuǎn)型時期,重新明確道德與法律之間的關(guān)系,理解道德法律化的含義及意義,發(fā)揮它應(yīng)有的積極作用。本人認(rèn)為,尋找道德與法律公認(rèn)的價值,作為社會價值的根基是十分必要的。道德法律化就是在這一共同價值理念基礎(chǔ)上實(shí)現(xiàn)道德與法律之間的轉(zhuǎn)換,幫助形成社會共識,并以此作為社會的道德根基加以推廣和適用。當(dāng)立法與司法都能體現(xiàn)法律的道德內(nèi)涵時,公民自覺守法才可能實(shí)現(xiàn)。在尊重道德與法律之間關(guān)系復(fù)雜性基礎(chǔ)上,不能全盤否定道德法律化,也不能無視道德法律化的消極面。要實(shí)現(xiàn)法治,公民必須具有基本的道德共識及素養(yǎng)。道德法律化的實(shí)現(xiàn)目標(biāo)是為了推動中國更快地實(shí)現(xiàn)以法治國。 全文由四部分組成: 第一部分,通過案例分析指出目前轉(zhuǎn)型時期,社會意識多元化對法律造成的影響,說明我們不但需要尋找道德與法律的共識作為價值判斷的依據(jù),還要重新認(rèn)識道德與法律之間的關(guān)系,尋找它們之間的平衡點(diǎn); 第二部分,通過總結(jié)國內(nèi)對道德與法律關(guān)系方面的理論研究,批判以凱爾遜為代表的實(shí)證主義觀點(diǎn),并闡述自己對兩者關(guān)系的認(rèn)識,在此基礎(chǔ)上提出要正確、客觀、全面地理解和認(rèn)識道德法律化; 第三部分,對道德法律化進(jìn)行學(xué)理分析,本文是從廣義的角度理解道德法律化,分析道德法律化的積極和消極面,,并總結(jié)對道德法律化的理解。 第四部分,重申道德法律化的研究意義,說明道德法律化不但能滿足公眾的道德情感需要,還能增強(qiáng)法律的權(quán)威。最后提出道德法律化應(yīng)如何適用等問題。
[Abstract]:With the development of social consciousness, people's understanding of morality and law is becoming more and more diverse in the era of increasingly diverse life. On the one hand, the tolerance of society is increasing, on the other hand, the understanding of the relationship between morality and law has become more complicated, and some people think that there is no necessary connection between morality and law. The law can be applied independently from the influence of morality; some people think that there is a link between morality and law, but the relationship is complicated. In the face of the present situation of social development, this paper attempts to analyze the relationship between morality and law as the theoretical basis, and preliminarily discuss the possible contribution of moral legalization in the pluralistic society. At present, many domestic scholars have different opinions on moral legalization. It is necessary for us to re-define the relationship between morality and law and understand the meaning and significance of moral legalization in view of the special period of transition in our country. Give play to its due positive role. In my opinion, it is necessary to seek the recognized values of morality and law as the foundation of social values. The legalization of morality is to realize the transformation between morality and law on the basis of this common value concept, to help form the social consensus, and to promote and apply it as the moral foundation of the society. When legislation and judicature can embody the moral connotation of law, citizens can abide by the law consciously. On the basis of the complexity of the relationship between respecting morality and law, the legalization of morality cannot be denied or the negative side of legalization of morality can not be ignored. To achieve the rule of law, citizens must have a basic moral consensus and literacy. The goal of moral legalization is to push China to realize the rule of law more quickly. The paper is composed of four parts: the first part, through the case analysis, points out the influence of the diversification of social consciousness on the law during the current transition period. It shows that we not only need to find a common understanding of morality and law as the basis of value judgment, but also need to re-understand the relationship between morality and law and find the balance between them. Through summing up the theoretical research on the relationship between morality and law in China, criticizing the positivism viewpoint represented by Kelson, and expounding his own understanding of the relationship between the two, on the basis of this, the author puts forward that we should be correct and objective. The third part is the theoretical analysis of moral legalization, this article is to understand moral legalization from a broad perspective, to analyze the positive and negative aspects of moral legalization, the third part is to analyze the positive and negative aspects of moral legalization. And summarizes the understanding of moral legalization. The fourth part restates the research significance of moral legalization, which shows that moral legalization can not only meet the moral emotional needs of the public, but also enhance the authority of the law. Finally, the author puts forward how to apply moral legalization and so on.
