【摘要】：本文以銳邦訴強(qiáng)生案案情為出發(fā)點(diǎn),通過(guò)對(duì)案中的轉(zhuǎn)售價(jià)格維持條款進(jìn)行反壟斷法上的分析,引出了價(jià)格機(jī)制對(duì)轉(zhuǎn)售價(jià)格維持條款的潛在影響,從而得出價(jià)格機(jī)制和價(jià)格政策能在很大程度上影響壟斷協(xié)議當(dāng)事人的市場(chǎng)行為的論斷,為我國(guó)反價(jià)格壟斷執(zhí)法提供了一條新的思路。
[Abstract]:Based on the case of Ruibang v. Johnson, this paper analyzes the resale price maintenance clause in the case, and leads to the potential influence of the price mechanism on the resale price maintenance clause. The conclusion that the price mechanism and price policy can greatly affect the market behavior of the parties to the monopoly agreement provides a new way of thinking for the enforcement of anti-price monopoly in China.
