中國、加拿大商標(biāo)法比較研究

【摘要】: 商標(biāo)是現(xiàn)代經(jīng)濟(jì)的產(chǎn)物,是非常重要的無形資產(chǎn),在企業(yè)的發(fā)展戰(zhàn)略中其作用不容忽視。因?yàn)樗休d著企業(yè)的希望,反映產(chǎn)業(yè)的特點(diǎn),積淀了企業(yè)的文化。 本文通過對(duì)中國、加拿大兩國商標(biāo)法的研究分析,指出了兩國商標(biāo)法各自的歷史沿革、特征區(qū)別,并著重分析了兩國商標(biāo)法在相同或類似問題上的不同規(guī)定,突出加拿大商標(biāo)法在這些方面的先進(jìn)性,并指出我國商標(biāo)法的一些不足。這些研究對(duì)我國商標(biāo)立法的改善,企業(yè)商標(biāo)戰(zhàn)略的建立,都有重要的現(xiàn)實(shí)意義。本文以中國和加拿大商標(biāo)法為研究對(duì)象,分析兩者之間的相同點(diǎn)和區(qū)別,旨在指出我國商標(biāo)立法的不足之處和加拿大商標(biāo)立法中可供我們借鑒的地方。本文運(yùn)用理論分析、比較分析等研究方法,圍繞商標(biāo)要素構(gòu)成,商標(biāo)申請(qǐng),商標(biāo)權(quán)及其保護(hù),馳名商標(biāo)等內(nèi)容進(jìn)行分析比較,主要的研究成果包括:(一)我國商標(biāo)法誕生于計(jì)劃經(jīng)濟(jì)時(shí)代,受到計(jì)劃經(jīng)濟(jì)僵化保守體制的重重制約,有先天不足之處;商標(biāo)法在市場(chǎng)經(jīng)濟(jì)時(shí)代有兩次重要的修改,尤其是2002年的修改,使商標(biāo)法有了質(zhì)的變化。本文指出了我國商標(biāo)法的發(fā)展變化和其中的意義,并著重論述了商標(biāo)的構(gòu)成、商標(biāo)權(quán)(商標(biāo)專用權(quán))、商標(biāo)侵權(quán)行為及保護(hù)、馳名商標(biāo);(二)加拿大商標(biāo)法分普通法和聯(lián)邦法兩個(gè)體系,本文對(duì)兩個(gè)體系中關(guān)于商標(biāo)和商標(biāo)權(quán)保護(hù)的不同規(guī)定進(jìn)行了簡單的比較,主要論述了聯(lián)邦商標(biāo)法的內(nèi)容,包括商標(biāo)的定義、商標(biāo)權(quán)構(gòu)成、商標(biāo)注冊(cè)、商標(biāo)侵權(quán)等內(nèi)容。(三)對(duì)一些相同或類似問題的不同規(guī)定進(jìn)行了比較,包括商標(biāo)構(gòu)成要素、禁止注冊(cè)條件、商標(biāo)侵權(quán)、證明商標(biāo)、注冊(cè)使用等內(nèi)容;總結(jié)了兩國商標(biāo)法的一些相同或類似之處,包括商標(biāo)的顯著性、三維商標(biāo)等。
[Abstract]:Trademark is a product of modern economy and a very important intangible asset, which can not be ignored in the development strategy of enterprises. Because it carries the enterprise's hope, reflects the industry characteristic, accumulates the enterprise culture. Based on the research and analysis of the trademark laws of China and Canada, this paper points out the historical evolution and characteristics of the trademark laws of the two countries, and emphatically analyzes the different provisions of the trademark laws of the two countries on the same or similar issues. It highlights the advanced nature of Canadian Trademark Law in these aspects, and points out some shortcomings of our Trademark Law. These studies have important practical significance for the improvement of trademark legislation and the establishment of trademark strategy. Taking the trademark law of China and Canada as the research object, this paper analyzes the similarities and differences between the two laws, aiming at pointing out the deficiencies of our trademark legislation and the points that can be used for reference in the Canadian trademark legislation. In this paper, theoretical analysis, comparative analysis and other research methods are used to analyze and compare the elements of trademark, trademark application, trademark rights and their protection, well-known trademarks, etc. The main research results include: (1) the trademark law of our country was born in the era of planned economy, which was restricted by the rigid and conservative system of planned economy, and has congenital deficiencies; the trademark law has two important modifications in the era of market economy. In particular, the 2002 amendment, so that the trademark law has a qualitative change. This paper points out the development and changes of trademark law in China and its significance, and emphasizes on the constitution of trademark, trademark right (trademark exclusive right), trademark infringement and protection. Well-known trademarks; (2) Canadian Trademark Law is divided into two systems: common Law and Federal Law. This paper makes a simple comparison between the two systems on the protection of trademarks and trademark rights, and mainly discusses the contents of the Federal Trademark Law. Including the definition of trademark, trademark right constitution, trademark registration, trademark infringement and so on. (3) to compare the different provisions on the same or similar issues, including the elements of trademark composition, the conditions of prohibition of registration, the infringement of trademarks, the certification of trademarks, the registration of trademarks, etc., and summarize some of the similarities or similarities of the trademark laws of the two countries, Including trademark salience, three-dimensional trademark and so on.
