【摘要】： 所謂等級(jí),是指以其經(jīng)濟(jì)政治地位為基礎(chǔ),由道德習(xí)慣及法律所確立的不同層級(jí)的社會(huì)集團(tuán),不同等級(jí)以及同一等級(jí)的不同等第,都分別享受不同權(quán)利、承擔(dān)不同義務(wù)。等級(jí)的劃分通常以法律的形式予以確定,作為17世紀(jì)衛(wèi)拉特蒙古的大法典,《蒙古—衛(wèi)拉特法典》鮮明地呈現(xiàn)了衛(wèi)拉特社會(huì)封建世俗等級(jí)和僧侶等級(jí)的狀況。 本文以《蒙古—衛(wèi)拉特法典》為研究對(duì)象,并輔以相關(guān)法律文獻(xiàn)和蒙漢文史料,運(yùn)用歷史學(xué)的基本研究方法,同時(shí)借鑒法學(xué)、社會(huì)學(xué)的相關(guān)理論和方法,力求客觀真實(shí)地展現(xiàn)《法典》誕生前后的17世紀(jì)衛(wèi)拉特蒙古社會(huì)等級(jí)結(jié)構(gòu)以及各等級(jí)的社會(huì)地位、權(quán)利義務(wù)、生存處境等基本情況,進(jìn)而加深對(duì)17世紀(jì)衛(wèi)拉特蒙古歷史的認(rèn)知。但《法典》不是包羅萬(wàn)象的,其它史料關(guān)于衛(wèi)拉特社會(huì)等級(jí)的記述也很有限,所以,全景式還原衛(wèi)拉特社會(huì)等級(jí)圖景是不可能的,本文所見(jiàn)僅是衛(wèi)拉特社會(huì)之一斑。
[Abstract]:The so-called rank refers to the social group of different levels established by moral custom and law based on its economic and political status. Different levels and different levels of the same rank enjoy different rights and undertake different obligations respectively. As the great code of Eilat Mongolia in the 17th century, the Mongolia-Eilat Code clearly presents the status of feudal, secular and monastic hierarchy in the Eilat society. This paper takes the Mongolia-Werat Code as the research object, and with the relevant legal documents and historical materials of Mongolian and Chinese, uses the basic research methods of history, and draws lessons from the relevant theories and methods of law and sociology. This paper tries to show objectively and realistically the social hierarchy structure, social status, rights and obligations, living situation and so on of the 17th century Mongolian society before and after the birth of the Code, so as to deepen the cognition of the Mongolian history of the 17th century. However, the Code is not all-encompassing, and other historical data about the social class of Eilat are also very limited. Therefore, it is impossible to restore the picture of social class in Werat in a panoramic way. What this paper sees is only a spot in the society of Eilat.
