【摘要】：中央商務(wù)區(qū)（CBD）是一個國家或大城市里主要商業(yè)活動進行的地區(qū)，是一個城市的名片和現(xiàn)代化的象征與標志。受經(jīng)濟發(fā)展水平不同和體制差異等因素的影響，世界不同國家和地區(qū)CBD的發(fā)展路徑各不相同。CBD的形成與發(fā)展主要取決于市場因素，但是政府的引導(dǎo)與調(diào)控顯得越發(fā)重要。隨著經(jīng)濟全球化、信息化的加快，CBD的發(fā)展已經(jīng)不可能只靠市場發(fā)展自發(fā)進行，近年來世界各主要城市的CBD的發(fā)展都出現(xiàn)政府干預(yù)不斷增強的現(xiàn)象。在此背景下，CBD管理的法制化成為CBD發(fā)展的必然趨勢。 本論文采用理論與實證相結(jié)合的研究方法，對CBD管理的法制化進行若干探討。本論文在第1章中對CBD的概念界定及功能進行梳理，并歸納出影響CBD發(fā)展的關(guān)鍵因素以及當前CBD的最新發(fā)展趨勢；在第2章中，通過對國內(nèi)外CBD政府管理的比較分析，透視各國CBD政府管理要素、管理模式及法制化實踐經(jīng)驗；在第3章中，通過分析我國各大城市CBD的發(fā)展現(xiàn)狀，歸納出我國在CBD建設(shè)與管理中的一些突出問題；在上述基礎(chǔ)之上，，第4章針對國內(nèi)外CBD的發(fā)展經(jīng)驗，提出我國CBD地方管理立法的初步構(gòu)想。本論文觀點認為，政府在現(xiàn)代CBD的發(fā)展過程中應(yīng)扮演服務(wù)、引導(dǎo)的角色，通過行政服務(wù)與政策服務(wù)支持、引導(dǎo)CBD的發(fā)展。CBD管理的法制化的宗旨，應(yīng)在于提高CBD政府管理的科學(xué)性，以使政府更好地發(fā)揮其服務(wù)職能。
[Abstract]:Central Business District (CBD) is a national or major city in the main business activities of the region, is a city's business card and modern symbol and symbol. Under the influence of different economic development level and system difference, the formation and development of CBD in different countries and regions of the world mainly depend on market factors, but the guidance and regulation of government is becoming more and more important. With the development of economic globalization, the development of information technology can not be carried out spontaneously by market development. In recent years, the development of CBD in major cities of the world has appeared the phenomenon of increasing government intervention. Under this background, the legalization of CBD management becomes the inevitable trend of CBD development. This paper discusses the legalization of CBD management with the combination of theory and practice. In chapter 1, the concept and function of CBD are defined, and the key factors that affect the development of CBD and the latest development trend of CBD are summarized. In Chapter 2, the comparative analysis of the government management of CBD at home and abroad is made. In Chapter 3, by analyzing the development situation of CBD in the major cities of China, we conclude some outstanding problems in the construction and management of CBD in our country. In chapter 4, according to the development experience of CBD at home and abroad, the preliminary conception of local management legislation of CBD in China is put forward. This paper holds that the government should play the role of service and guidance in the development of modern CBD, and guide the development of CBD through the support of administrative services and policy services. It is necessary to improve the scientific nature of CBD government management so that the government can give full play to its service function.
