【摘要】： 1978年以后,我國展開了以立法為中心構建我國法制基本框架的法制化運動,我國理論界對于法定權利的相關問題展開廣泛而深入的討論,但是對于與法定權利有著不可分割的邏輯聯系的習慣權利的研究在當今的學術體系中并不深入。目前對于習慣權利的大部分論述多停留在概念、特征的層面,與社會實踐結合的很少。本文首先試圖通過對習慣權利內涵、特征、演變發(fā)展過程、作用和意義以及其表現形式和行使條件的系統(tǒng)總結和整理,使習慣權利的自身理論體系更加的清晰和完善,同時也為習慣權利在各國法治實踐部分中的地位和作用打下良好的理論基礎。其次,本文從實證的角度分析闡述了習慣權利與法定權利的關系及沖突,并根據世界各國對于習慣權利和法定權利的沖突的處理方法,進行了較詳盡的總結。且這些方法對于我國的法治化的實踐有著很強的借鑒意義。進而對于我國在法治化進程中如何處理習慣權利與法定權利的沖突提出了自己的一點薄見。 本文主要通過大量詳實的例證,從空間和時間兩個維度,以歷史的眼光對習慣權利的理論和實踐進行了充分的論證。對于習慣權利和法定權利的關系從多個角度、多個側面進行了詳細的闡述和分析。對于世界各國處理習慣權利與法定權利沖突的方法的部分,以空間為主線,時間為輔線,進行較完整的歸納與總結。 本文通過對習慣權利詳細的整理、歸納、分析和總結,基本上把握了習慣權利的運行規(guī)律和本質特征。認為只有認真面對習慣權利的運行規(guī)律和本質特征,才能夠順應潮流,傳承文化。只有正確把握習慣權利和法定權利的關系,恰當處理習慣權利與法定權利的沖突,才能使正在轉型中的中國的法治進程更加順暢,從而符合當下和諧社會的建設的法治要求。
[Abstract]:Since 1978, our country has launched the legalization movement of constructing the basic framework of our country's legal system with legislation as the center, and the theoretical circle of our country has carried out extensive and in-depth discussion on the related issues of legal rights. However, the study of customary rights, which is inextricably linked with legal rights, is not deep in the academic system. At present, most of the discussions on customary rights remain at the level of concept and characteristics, and seldom combine with social practice. First of all, this paper tries to make the theoretical system of customary rights more clear and perfect through the systematic summary and arrangement of the connotation, characteristics, evolution and development process, function and significance of customary rights, as well as their forms of expression and conditions of exercise, in order to make the theoretical system of customary rights more clear and perfect. At the same time, it lays a good theoretical foundation for the position and function of customary rights in the practice of rule of law in various countries. Secondly, this paper analyzes the relationship and conflict between customary rights and legal rights from the perspective of empirical analysis, and makes a detailed summary according to the methods of dealing with the conflicts between customary rights and legal rights in various countries in the world. And these methods have very strong reference significance for the practice of rule of law in our country. Furthermore, the author puts forward his own suggestion on how to deal with the conflict between customary right and legal right in the process of rule of law in our country. This article mainly through a lot of detailed examples, from the space and the time two dimensions, has carried on the full demonstration to the custom right theory and the practice from the historical vision. The relationship between customary right and legal right is elaborated and analyzed from many angles and aspects. For the part of the methods of dealing with the conflict between customary right and legal right, the space is the main line and time is the auxiliary line. Through the detailed arrangement, induction, analysis and summary of customary rights, this paper basically grasps the running law and essential characteristics of customary rights. The author thinks that only by seriously facing the running rules and essential characteristics of customary rights can we conform to the trend and inherit culture. Only by correctly grasping the relationship between customary rights and legal rights and properly handling the conflicts between customary rights and legal rights can the process of rule of law in China in transition be more smooth and meet the requirements of the rule of law in the construction of a harmonious society at present.
