【摘要】： 建設(shè)社會(huì)主義法治國(guó)家,既要有健全的法律體系,也需要有一支高素質(zhì)的法律職業(yè)共同體隊(duì)伍。但目前我國(guó)還未形成一個(gè)相對(duì)獨(dú)立的法律職業(yè)者階層。當(dāng)前影響我國(guó)法律職業(yè)共同體構(gòu)建的主客觀因素很多,其中一個(gè)重要的問題就是法律職業(yè)倫理問題。職業(yè)倫理的缺失,造成了司法腐敗嚴(yán)重,也直接影響法律職業(yè)的聲譽(yù)和形象,直接威脅到司法的公正,從根本上阻礙依法治國(guó)方略的實(shí)施。法學(xué)院校作為法律人才最主要的培育基地,其教育功能對(duì)我國(guó)法律人才的培養(yǎng),對(duì)我國(guó)法律職業(yè)共同體的構(gòu)建乃至對(duì)我國(guó)法治建設(shè)進(jìn)程,都起著至關(guān)重要的作用。在我國(guó)高校法學(xué)教育中,如何培養(yǎng)出又“紅”又“�！钡姆ǹ飘厴I(yè)生,使其正義與技藝或者德行與才干兼具,使所有成員在素質(zhì)上都能盡量達(dá)到道德與業(yè)務(wù)能力之間的均衡,已成為我國(guó)法學(xué)教育亟待研究和解決的問題。 全文以法律職業(yè)為引線,立足于我國(guó)法律職業(yè)道德教育的現(xiàn)狀,通過對(duì)法律職業(yè)道德教育的必要性及弱化原因的分析,特別是對(duì)法律職業(yè)道德及法律職業(yè)道德教育的獨(dú)特性進(jìn)行挖掘和剖析,旨在對(duì)我國(guó)法律職業(yè)道德教育所要遵守的基本原則及我國(guó)法律職業(yè)道德教育的實(shí)現(xiàn)的基本路徑做出有益的探索。 全文分五個(gè)部分。第一部分從法律與道德的關(guān)系,法律職業(yè)道德教育的使命,法律職業(yè)道德與法律職業(yè)的關(guān)系等方面分析了我國(guó)法律職業(yè)道德教育的必要性;第二部對(duì)我國(guó)法律職業(yè)道德教育的現(xiàn)狀進(jìn)行了全面介紹,并對(duì)造成現(xiàn)狀的原因進(jìn)行深入的分析;第三部分對(duì)法律職業(yè)道德及法律職業(yè)道德教育的本質(zhì)及特征進(jìn)行了深入挖掘和闡釋;第四部分了提出了我國(guó)法律職業(yè)道德教育應(yīng)該堅(jiān)持的原則和理念,在此基礎(chǔ)上提出我國(guó)法律職業(yè)道德教育的實(shí)現(xiàn)途徑;文章最后對(duì)全文做了總結(jié),重申我國(guó)法律道德教育的重要性及緊迫性,希望能對(duì)法律職業(yè)道德教育規(guī)律進(jìn)一步的深入研究,為我國(guó)法制建設(shè)培養(yǎng)出技術(shù)與道德兼具的法律職業(yè)人才。
[Abstract]:The construction of a socialist country under the rule of law requires a sound legal system and a high quality legal professional community. But at present, a relatively independent class of legal professionals has not been formed in our country. At present, there are many subjective and objective factors affecting the construction of the legal profession community in China, and one of the important issues is the law. The problem of professional ethics, the lack of professional ethics, has caused serious judicial corruption, which directly affects the reputation and image of the legal profession, directly threatens the justice of the judiciary, and fundamentally impede the implementation of the rule of law. The legal academy is the main cultivation base of the legal talents, and its educational function is trained to the legal talents of our country. The construction of the legal professional community of the country and even the process of the construction of the rule of law in our country plays a vital role. In the law education of China's colleges and universities, how to cultivate "red" and "special" French graduates so that their justice and skill or virtue and ability can be concurrently achieved, so that all members can achieve moral and business ability in their quality as far as possible. The balance between forces has become a problem that needs to be studied and solved in Chinese legal education.
The full text is based on the legal profession as the lead, based on the present situation of the legal professional ethics education in China, and through the analysis of the necessity and the reasons for the weakening of the legal professional moral education, especially the uniqueness of the legal professional ethics and the legal professional moral education, aiming at the basis for the legal professional ethics education in our country to abide by. This principle and the basic path of the realization of our legal professional ethics education make a useful exploration.
