【摘要】：正第三人為開(kāi)證申請(qǐng)人提供開(kāi)證擔(dān)保時(shí),開(kāi)證行在享有擔(dān)保權(quán)人權(quán)益的同時(shí)也面臨諸多風(fēng)險(xiǎn)點(diǎn),而當(dāng)前商業(yè)銀行的信用證操作模式極易觸發(fā)這些風(fēng)險(xiǎn)點(diǎn),導(dǎo)致漏保、脫保風(fēng)險(xiǎn)事件的發(fā)生。準(zhǔn)確識(shí)別銀行接受信用證擔(dān)保中存在的潛在風(fēng)險(xiǎn)對(duì)商業(yè)銀行意義重大,以演繹與歸納相結(jié)合的研究方法,分析第三人向開(kāi)證行提供開(kāi)證擔(dān)保時(shí)潛在風(fēng)險(xiǎn)點(diǎn),并提出相應(yīng)的防范建議,有利于商業(yè)銀行構(gòu)建牢固的風(fēng)險(xiǎn)防控體系。一、案例簡(jiǎn)介1997年4月15日,浙江某毛
