【摘要】：奈良律令從體系架構(gòu)到條文注疏均承襲唐制,尤其是在篇名篇次、合并論罪、刑名界定、法律監(jiān)督、中央機(jī)構(gòu)和田制、租庸調(diào)制等方面,均延續(xù)唐朝律令的血脈。但與此同時(shí),奈良時(shí)代日本對(duì)唐朝律令的學(xué)習(xí)過(guò)程,也是日本繼承創(chuàng)新、建立健全自身律令的過(guò)程。由于日本國(guó)土狹小、天皇傳統(tǒng)及崇信佛教等原因,奈良時(shí)代日本又推出"六議"、"八虐"、"兩官八省一臺(tái)五衛(wèi)"、單設(shè)神yG官及班田收授法等頗具本土特色的律令條款。奈良律令均透射出我國(guó)唐律的氣派,帶有濃郁的大唐色彩,又具有日本的本土特征。奈良律令為日本進(jìn)入封建制階段提供了保障,標(biāo)志著日本進(jìn)入"律令國(guó)家"。
[Abstract]:Nara's law and order inherited the Tang system from the system structure to the article notes, especially in the following aspects: the famous articles, the combination of crimes, the definition of the criminal name, the legal supervision, the central organization and the farmland system, the rent Yong modulation, and so on, all of which continued the blood line of the Tang Dynasty laws and decrees. But at the same time, Japan's learning process of Tang Dynasty laws and decrees in Nara era is also the process of Japan inheriting innovation and establishing and perfecting its own laws and decrees. Because of Japan's small territory, emperor's tradition and worship of Buddhism, Nara era Japan also introduced "six discussions", "eight masochism", "two officials, eight provinces, one Taiwan, five Wei", only set up God YG officials and ban Tian received the law, and other relatively local characteristics of the provisions. Nara's laws and decrees all reflect the style of Tang Law of our country, with strong color of Tang Dynasty and native characteristics of Japan. Nara law provides a guarantee for Japan to enter the feudal system and marks Japan's entry into the legal state.
