論唐律中的不孝罪

【摘要】:“孝”本是人類基于血緣及養(yǎng)育關(guān)系而產(chǎn)生的自然情感,一般僅限于家庭(族人)的層面,但在中國古代,由于家國一體的社會結(jié)構(gòu),統(tǒng)治者遂移孝作忠,標(biāo)榜“以孝治天下”,故“孝”成為中國古代社會的主流意識形態(tài)。本文以《唐律》為著眼點(diǎn),著重敘述不孝罪的法律界定及司法制裁,說明孝由倫理道德轉(zhuǎn)化為法律義務(wù),并最終成為統(tǒng)治階級治世工具的這一過程。同時還兼述了什么是孝,什么是孝道及孝和孝道興起的原因、含義和表現(xiàn)形式這些在學(xué)界還存有異議的問題,并得出了自己最終的結(jié)果。文章的最后還敘述了不孝罪對唐代家庭的影響和中國古代社會為何如此重孝,以至于孝不僅僅影響了兩千多年的封建社會,而且還深深地影響著現(xiàn)代的中國家庭。因此當(dāng)下社會應(yīng)本著剔除其封建性的糟粕,吸收其民主性的精華的態(tài)度,總結(jié)歷史經(jīng)驗(yàn)教訓(xùn),結(jié)合現(xiàn)實(shí),大力發(fā)揚(yáng)其中養(yǎng)老敬老的傳統(tǒng)美德,強(qiáng)化法律對不孝的制約。這樣才能增強(qiáng)我們現(xiàn)代家庭的凝聚力、促進(jìn)社會和國家穩(wěn)定、建設(shè)社會主義精神文明和加快全面建設(shè)小康社會的步伐。
[Abstract]:"filial piety" is the natural emotion of human beings based on blood relationship and nurturing relationship, which is usually limited to the level of family (people). But in ancient China, due to the social structure of family and country, the ruler moved filial piety to be loyal. As a result, filial piety has become the mainstream ideology of ancient Chinese society. Based on Tang Law, this paper focuses on the legal definition and judicial sanction of unfilial piety, and explains the process of transforming filial piety from ethics to legal obligation, and finally becoming the ruling class's tool of governing the world. At the same time, it also describes what is filial piety, what is filial piety and the reason of filial piety and filial piety rise, meaning and form of expression, which are still in dissent in academic circles, and get their own final results. At the end of the article, it also describes the influence of the crime of unfilial piety on the family of Tang Dynasty and why the ancient Chinese society was so filial piety that filial piety not only influenced the feudal society for more than two thousand years, but also deeply influenced the modern Chinese family. Therefore, the present society should be guided by the attitude of eliminating its feudal dross, absorbing its democratic essence, summing up historical experience and lessons, combining with reality, vigorously developing the traditional virtue of respecting the aged and strengthening the restriction of law on unfilial behavior. Only in this way can we strengthen the cohesion of our modern family, promote social and national stability, build socialist spiritual civilization and accelerate the pace of building a well-off society in an all-round way.
