【摘要】：學(xué)界一般認(rèn)為宋朝是典權(quán)法律制度的成熟階段因而給予特別關(guān)注,卻對宋朝之前的典權(quán)法律制度研究甚少。任何成熟的法律制度都不是一蹴而就的。在典權(quán)法律制度漫長的發(fā)展過程中,唐末五代時(shí)期是一個(gè)重要的流變和積淀階段。唐末五代時(shí)期典權(quán)法律制度以"貼典"、"質(zhì)"等為存在形式,逐步形成了該時(shí)期頗具特色的典權(quán)法律制度基本樣態(tài)。該種樣態(tài)的形成有制度上、經(jīng)濟(jì)上、文化上的原因,并在實(shí)際運(yùn)行過程中表現(xiàn)出多樣性與靈活性。唐末五代時(shí)期形成的典權(quán)法律制度在縱向發(fā)展脈絡(luò)上為后世提供了基本模型,且以其獨(dú)特的優(yōu)勢在社會劇變中發(fā)揮了維持社會穩(wěn)定的積極作用,體現(xiàn)了中國人民卓越的生存智慧。
[Abstract]:The scholars generally think that the Song Dynasty is the mature stage of the legal system of the pawning power, so it pays special attention, but little research on the legal system of the pawning right before the Song Dynasty. Any mature legal system is not achieved overnight. In the long development process of the legal system of the pawning power, the late Tang and Five Dynasties period is an important stage of rheology and accumulation. The legal system of pawning power in the Five Dynasties was formed in the form of "Plaster" and "quality", and gradually formed the basic pattern of the legal system of pawning power in this period. The form of this kind of form has the institutional, economic and cultural reasons, and shows diversity and flexibility in the process of actual operation. The legal system of pawning rights formed during the Five Dynasties of the Tang Dynasty and the late Tang Dynasty It provides the basic model for the future generations in the longitudinal development context, and has played a positive role in maintaining social stability in the social upheaval with its unique advantages, reflecting the excellent survival wisdom of the Chinese people.
