【摘要】： 哈爾濱解放區(qū)刑事法規(guī)在特殊的歷史使命下包含著針對性較強(qiáng)的內(nèi)容,體現(xiàn)了時代的特點,具有重要的歷史地位。由于解放戰(zhàn)爭時期,哈爾濱具有建立鞏固的戰(zhàn)略后方,支援前線,保障戰(zhàn)爭的勝利的使命,哈爾濱解放區(qū)的刑事法規(guī)就肩負(fù)著保障哈爾濱的政權(quán)穩(wěn)定、社會穩(wěn)定、經(jīng)濟(jì)發(fā)展與法制發(fā)展的歷史重任。其發(fā)展階段性明顯,可以分為三個發(fā)展階段:一、1946年4月28日——1947年上半年:刑事法規(guī)大量立法時期;二、1947年下半年——1948年:刑事法規(guī)數(shù)量穩(wěn)定時期;三、1949年初——新中國成立:刑事法規(guī)數(shù)量減少時期。這三個階段的刑事法規(guī)在不同的歷史時期起到了重要的作用,穩(wěn)定了哈爾濱解放區(qū)社會秩序,保障了其經(jīng)濟(jì)發(fā)展,完成了支援東北解放戰(zhàn)爭乃至全國解放戰(zhàn)爭的使命,并且為哈爾濱解放區(qū)刑事法規(guī)建設(shè)向新中國刑事法規(guī)建設(shè)過渡奠定了基礎(chǔ)。但是由于當(dāng)時法制的不健全和社會秩序的混亂,哈爾濱解放區(qū)的刑事法規(guī)存在著一些局限性。雖然如此,哈爾濱解放區(qū)刑事法規(guī)仍具有重要的歷史地位。筆者通過對哈爾濱解放區(qū)刑事法規(guī)在不同階段制定的不同內(nèi)容進(jìn)行研究得出其特點,分析它存在的缺憾,評價其歷史地位,以求將哈爾濱解放區(qū)刑事法規(guī)真實的史實呈現(xiàn)出來。
[Abstract]:The criminal laws and regulations of Jiefang District, Harbin, contain the pertinent content under the special historical mission, which embodies the characteristics of the times and has an important historical position. Because of the period of the liberation war, Harbin has the mission of establishing the consolidated strategic rear, supporting the front line and ensuring the victory of the war, and the criminal laws and regulations of Harbin Jiefang District are on the shoulder. To ensure Harbin's political stability, social stability, economic development and the development of the legal system, its development stage is obvious and can be divided into three stages of development: first, April 28, 1946 - the first half of 1947: a large number of criminal legislation period; two, the next half year of 1947 - 1948: the stable period of criminal laws and regulations; three, early 1949. The establishment of the new China: the period of the reduction in the number of criminal laws and regulations. The criminal laws and regulations of these three stages have played an important role in different historical periods, stabilizing the social order of Jiefang District in Harbin, ensuring its economic development, completing the mission of supporting the war of Liberation in the northeast and the whole country, and the criminal law of Jiefang District in Harbin. The construction of laws and regulations has laid the foundation for the transition of criminal laws and regulations in New China. However, because of the unsound legal system at that time and the confusion of the social order, there are some limitations in the criminal laws and regulations of Jiefang District in Harbin. Although the criminal laws and regulations of Harbin Jiefang District still have an important historical position. The author of the criminal law of Jiefang District in Harbin has passed the criminal law of Jiefang District. The characteristics of the different contents in different stages are studied, and the shortcomings of its existence are analyzed and its historical status is evaluated in order to present the true historical facts of the criminal laws and regulations of Jiefang District in Harbin.
