【摘要】：正從18、19世紀(jì)起,少數(shù)國家出現(xiàn)政黨立法的萌芽,冷戰(zhàn)結(jié)束前,僅有50多個國家對政黨問題作出憲法性解釋。冷戰(zhàn)結(jié)束后,對政黨進(jìn)行立法的國家激增到123個,頒布政黨法的國家迅速增至90多個。但是,這種"活躍"發(fā)展,僅僅說明了不同國家鞏固政權(quán)、維護(hù)穩(wěn)定的特殊政治需要。一、國外政黨立法目的各異基于歷史教訓(xùn),通過政黨立法防止獨(dú)裁和權(quán)力壟斷。這在較早對政黨進(jìn)行立法的西方國家中比較突出,旨在確
[Abstract]:From the 1800s to the 19th century, a few countries appeared the germination of the party legislation. Before the end of the Cold War, only more than 50 countries gave the constitutional interpretation of the political party problem. Since the end of the Cold War, the number of countries that have legislated on political parties has soared to 123, and the number of countries that have enacted political party laws has risen rapidly to more than 90. However, this dynamic development only illustrates the special political needs of different countries to consolidate political power and maintain stability. First, foreign political party legislation aims at preventing dictatorship and monopoly through party legislation based on historical lessons.
