【摘要】： 近年來,高校學(xué)費(fèi)上漲幅度很大,學(xué)費(fèi)上漲帶來了一系列的連鎖反映,導(dǎo)致美國高校學(xué)生經(jīng)濟(jì)負(fù)擔(dān)過重,一批家庭收入低的家庭難以負(fù)擔(dān)學(xué)費(fèi),不能進(jìn)入高一級學(xué)校進(jìn)行學(xué)習(xí)。高等教育入學(xué)率增加的同時(shí),輟學(xué)率也在增加。除了因?yàn)閷W(xué)費(fèi)問題而輟學(xué)的學(xué)生外,由于高等教育入學(xué)政策寬松,還存在一部分經(jīng)濟(jì)獨(dú)立但是負(fù)擔(dān)較重(包括可能有家庭或者不想依靠父母獨(dú)立生活)的學(xué)生,獎(jiǎng)學(xué)金和貸款的制定為這些學(xué)生提供方便學(xué)習(xí)條件。 美國是“法律至上”的國家,美國聯(lián)邦和州通過教育法規(guī)對于學(xué)生資助進(jìn)行干預(yù),加強(qiáng)了政府統(tǒng)一管理;多元化的資助,為更多的學(xué)生提供接受高等教育的機(jī)會(huì),有效地防止一部分因?yàn)閾?dān)負(fù)不起學(xué)費(fèi)而輟學(xué)的優(yōu)秀生源流失。從教育法規(guī)角度來研究美國學(xué)生資助,可以看到美國相關(guān)的法律制度比較健全。關(guān)注到不同層次的人群,有效地保護(hù)學(xué)生的權(quán)利。就其可借鑒性而言,法制化國家有許多共同之處,對于我國高等教育立法的制定以及理論建設(shè)具有一定借鑒意義。 本文通過對美國高校學(xué)生資助的教育法規(guī)研究,闡明美國高校學(xué)生資助教育法規(guī),產(chǎn)生與發(fā)展的歷史進(jìn)程,以及教育法規(guī)的內(nèi)容、立法依據(jù)與理念,教育法規(guī)的實(shí)施效果。 第一部分:美國高校學(xué)生資助教育法規(guī)產(chǎn)生和發(fā)展的歷史進(jìn)程,從二戰(zhàn)前和二戰(zhàn)后兩個(gè)時(shí)期對美國高校學(xué)生資助教育法規(guī)產(chǎn)生和發(fā)展的歷史進(jìn)程做出詳細(xì)的闡述。 第二部分:美國高校學(xué)生資助教育法規(guī)體系。從立法程序與立法內(nèi)容兩個(gè)方面對于學(xué)生資助教育立法體系進(jìn)行論述。 第三部分:美國高校學(xué)生資助教育法規(guī)的實(shí)施效果。從教育法規(guī)對美國高校學(xué)生資助的教育經(jīng)費(fèi)投入增加、資助方式多元化,擴(kuò)大不同階層學(xué)生接受教育的機(jī)會(huì)、獎(jiǎng)學(xué)金制度推動(dòng)學(xué)科的建設(shè)和發(fā)展幾個(gè)方面加以論述學(xué)生資助教育法規(guī)的實(shí)施效果。 第四部分:美國高校學(xué)生資助教育法規(guī)的特點(diǎn)和思考。關(guān)于美國高校學(xué)生資助教育法規(guī)的特點(diǎn)論述,包括:公平性;民主性;統(tǒng)一與分權(quán)相結(jié)合三個(gè)特點(diǎn)主要分析美國高校學(xué)生資助的教育法規(guī)的優(yōu)勢與存在問題的評價(jià)。以及對教育法規(guī)推動(dòng)高校學(xué)生資助的發(fā)展的啟示的思考。
[Abstract]:In recent years , the rise in tuition fees in colleges and universities has resulted in a series of chain reactions , which have led to a series of chain reactions , which have led to the high school student economy in the United States . The higher education enrolment rate has also increased . In addition to students who drop out of school because of school fees , there are also some students who are financially independent but have a heavier burden ( including the possibility of families or who do not want to rely on their parents to live independently ) , and the development of scholarships and loans provides them with convenient learning conditions .



The United States is the " supreme law " country , the United States federal and state through education laws and regulations for the student financing to intervene , strengthen the government unified management ; the diversification fund , provides more students with the opportunity to accept the higher education , effectively prevent part because of the lack of tuition fees to drop out of the excellent student source loss . From the educational regulation angle to study the American student fund , can see the United States relevant legal system comparatively perfect . With regard to the people of different levels , the law country has many common things , has certain reference significance for the development of the higher education legislation of our country and the theory construction .



Through the research on the educational regulations funded by American college students , this paper expounds the historical process of financing educational legislation , production and development of American college students , the content of educational regulations , the legislative basis and the implementation effect of educational regulations .



The first part : The historical process of the generation and development of American college students ' financing education laws and regulations , and the historical process of the generation and development of American college students ' financing education regulations during the two periods before and after World War II .



The second part : The American college students funded the educational regulation system . From the legislative procedure and the legislative content , the students funded the educational legislation system .



The third part : The effect of the American college students ' financing laws and regulations . From the educational regulations , the education funds funded by American college students are increased , the mode of financing is diversified , the chances that students of different classes receive education are expanded , the scholarship system promotes the construction and development of the disciplines , and the effect of the students ' financing laws is discussed .



The fourth part : The characteristics and reflections of the American college students ' financing education regulations . The characteristics of the legislation on the financing of college students in the United States include : fairness , democracy , unity and decentralization , which are mainly used to analyze the advantages and problems of the educational regulations funded by American college students .
