【摘要】： 法律不一致的原因很復雜,有其必然原因(如:法律的不和目的性、不周延性、滯后性),也有其偶然原因(違反邏輯學的不矛盾律)。本文試從邏輯學不矛盾律的視角對法律中違反不矛盾律的現(xiàn)象,從立法(法律體系)及法律的適用兩個環(huán)節(jié)進行考察和分析,論述法律的一致性。 本文包括以下三部分: 第一部分,對本文涉及法律的基本概念進行梳理和考察:首先,是通過對法律的概念作出細致的分析,揭示法律的本質。其次,對“一致性”概念從詞源上及邏輯的視角考察,揭示出其邏輯上的含義。 第二部分,以邏輯不矛盾律的視角從法律概念、法律規(guī)范及法律整體的協(xié)調一致性三個方面論述法律體系的一致性。 第三部分,以邏輯不矛盾律的視角對從訴訟證據(jù)、審判活動兩個方面論述了法律適用的一致性。
[Abstract]:The reasons of legal inconsistency are very complicated, and there are some inevitable reasons (such as the disharmony of law, inconsiderate ductility, tardiness, or accidental reasons (violating the law of inconsistency of logic). " This paper tries to analyze the phenomenon of violating the law from the angle of the law of logic, and discusses the consistency of law from two aspects: legislation (legal system) and the application of law. This paper includes the following three parts: In the first part, the author combs and inspects the basic concepts of law: firstly, it reveals the essence of law through careful analysis of the concept of law. Secondly, from the perspective of etymology and logic, the concept of consistency reveals its logical meaning. The second part discusses the consistency of the legal system from three aspects: the concept of law, the legal norm and the coordination and consistency of the whole law. The third part discusses the consistency of the application of law from two aspects of litigation evidence and trial activity from the angle of the law of logic noncontradiction.
