【摘要】：女權保護不僅是立法的任務,更須在司法中得到落實,如何適用法律對婦女權利保護至關重要。在民國一起婦女訴請別居案中,雖然《中華民國民法》并未規(guī)定別居制度,按照民法傳統(tǒng)理論,當事人不能享有訴請別居的訴權。然而在南京國民政府時期,司法官秉持社會本位司法理念,突破法律常規(guī),以保護婦女權利的社會價值共識指導司法過程,賦予婦女訴請別居的訴權,并在別居后的權利義務安排上予以照顧,從而使婦女權利得到了保護。
[Abstract]:The protection of women's rights is not only the task of legislation, but also must be implemented in the administration of justice. How to apply the law is of great importance to the protection of women's rights. Although the Civil Law of the Republic of China did not stipulate the system of different residence, according to the traditional theory of civil law, the litigant could not enjoy the right of action. However, during the period of the Nanjing National Government, the magistrates adhered to the social standard judicial idea, broke through the legal convention, guided the judicial process with the social value consensus of protecting the women's rights, and gave women the right to appeal to others. And the rights and obligations of the rest of the arrangements to be taken care of, so that women's rights are protected.
