【摘要】：關(guān)于中律與西法的關(guān)系,修律大臣沈家本認(rèn)為,中律重經(jīng)驗(yàn)而西法重學(xué)理,二者同出于"情理",據(jù)此可以會(huì)而通之。沈家本的會(huì)通思想深受時(shí)代思潮、學(xué)術(shù)訓(xùn)練和角色期望的影響。修律前期他以經(jīng)世致用為基礎(chǔ),然而經(jīng)世致用在通經(jīng)與致用、中學(xué)與西學(xué)的關(guān)系認(rèn)知上有著巨大的缺陷,沈氏開始借助比附和化約來(lái)彌合,最終使其"不持門戶之見(jiàn)"的會(huì)通目的未能貫徹。媒介東西法系成為眷屬的夢(mèng)想終因客觀不能、主觀無(wú)力而成為溫情歷史認(rèn)知下的一種幻影。
[Abstract]:On the relationship between Chinese law and western law, Shen Jiaben, minister of law practice, thinks that the law of the middle law attaches importance to experience while the western law attaches importance to the theory of science, both of which are both out of "reason" and can be connected accordingly. Shen Jiaben's idea of Huitong is deeply influenced by the trend of thought, academic training and role expectation. In the early period of practicing the law, he was based on the practical use of the world. However, there were huge defects in the cognition of the relationship between the meridian and the application, the middle school and the western learning. Shen began to use the covenant of agreement to bridge it. Finally, its "do not hold an open mind" the purpose of communication failed to carry out. The dream of becoming a dependant in the media law system becomes a kind of illusion under the historical cognition of tenderness because of objective inability and subjective powerlessness.
