【摘要】：毛澤東法律思想是毛澤東思想體系中不可分割的重要組成部分,具有十分豐富和完整的內(nèi)容。在領(lǐng)導(dǎo)創(chuàng)建新民主主義法制和社會(huì)主義法制的長(zhǎng)期實(shí)踐中,毛澤東創(chuàng)造并積累了多方面的經(jīng)驗(yàn),形成了許多獨(dú)特的思想理論。從法學(xué)基礎(chǔ)理論的角度看,他對(duì)憲政的追求與實(shí)踐,對(duì)公平正義的踐行,對(duì)人民利益的維護(hù)和對(duì)人民民主方式的探索,無(wú)一不是毛澤東法律思想中的瑰寶。 毛澤東的法律思想,理論鮮明獨(dú)特,實(shí)踐復(fù)雜曲折。其留下的深刻的經(jīng)驗(yàn)教訓(xùn),是中國(guó)人民革命和建設(shè)的長(zhǎng)期進(jìn)程中毛澤東法律思想的完整、復(fù)雜和曲折的呈現(xiàn)。毛澤東法律思想的精髓從一個(gè)側(cè)面豐富了毛澤東思想的科學(xué)體系,并且不斷地被繼承、完善、發(fā)展和創(chuàng)新,對(duì)中國(guó)特色社會(huì)主義民主政治建設(shè)具有很強(qiáng)的指導(dǎo)和借鑒意義。 本文對(duì)毛澤東法律思想進(jìn)行了探究,其中他的憲政思想、反對(duì)特權(quán)的平等思想、慎刑思想和民主思想,均是毛澤東法律思想的核心內(nèi)容,反映了毛澤東思想科學(xué)體系的豐富和完善。毛澤東法律思想具備以下幾個(gè)特質(zhì):法律本質(zhì)的人民性、法律適用的靈活性、法律運(yùn)行的民主性和法律價(jià)值的平等性。 研究毛澤東的法律思想,重在探尋其當(dāng)代價(jià)值和啟示。毛澤東的法律思想,對(duì)國(guó)人起到了憲政思想的啟蒙作用,為共和國(guó)奠定了公平正義思想的基礎(chǔ),其確立的人民利益至上的思想和初步形成的民主方式,為中國(guó)法制大廈的形成和發(fā)展起到了奠基的作用。因此,全面深刻地認(rèn)識(shí)并繼承、完善和發(fā)展毛澤東法律思想,具有十分重要的理論意義和實(shí)踐意義。
[Abstract]:Mao Zedong ' s legal thought is an integral part of Mao Zedong ' s thought system , and has very rich and complete content . In the long - term practice of leading the creation of new democratic rule and socialist legal system , Mao Zedong created and accumulated a lot of unique thought theory . From the point of view of the basic theory of law , his pursuit and practice of constitutional government , the practice of fairness and justice , the maintenance of the interests of the people and the exploration of the democratic way of the people are not the treasures of Mao Zedong ' s legal thought .

Mao Zedong ' s legal thought , the theory is distinct and unique , the practice is complex and tortuous . The profound lessons learned are the complete , complex and tortuous presentation of Mao Zedong ' s legal thought in the long - term process of the Chinese people ' s revolution and construction . The essence of Mao Zedong ' s legal thought has enriched the scientific system of Mao Zedong Thought from one side , and has been continuously inherited , perfected , developed and innovated , and has very strong guidance and reference for the construction of socialism democratic politics with Chinese characteristics .

Mao Zedong ' s legal thought and the enlightenment of Mao Zedong ' s legal thought have played a foundation for the formation and development of China ' s legal system building . Therefore , it is of great theoretical significance and practical significance to fully understand and inherit , perfect and develop Mao Zedong ' s legal thought .
