【摘要】： 社會法傾斜性保護原則,秉承不同情況不同對待的理念,立足于當事人之間的具體差別以及由此產生的實質不平等社會關系,并把這種不平等的關系作為規(guī)制對象,用一種不平等對待原則去矯正不平等的現象,從而使失衡的社會關系得到恢復,使弱勢群體的權利得到保障。本文擬在憲政的語境下,以社會權為支點,從社會法傾斜性保護原則提出的背景分析入手,闡述社會法傾斜性保護原則的涵義,探尋社會法傾斜性保護原則的憲法基礎,分析社會法傾斜性保護原則的理論和現實意義,并結合我國的現實情況探討在社會法傾斜性保護原則指引下如何進行法制建設。 全文四萬余字,共分為四部分。 第一部分,社會法傾斜性保護原則的概述。從市場經濟下社會問題的凸顯、弱勢群體的涌現出發(fā),通過對平等原則的闡釋以及對追求形式平等可能帶來弊端的剖析,筆者得出:為緩解社會矛盾、解決社會問題而產生的社會法應當貫徹傾斜性保護原則,以傾斜對待的方式來彌補弱勢特質,實現社會利益的平衡。筆者認為,社會法的傾斜性保護原則由保護弱勢群體、政府的保護責任、傾斜立法三方面組成。針對以上三方面,筆者進行了認真分析,得出結論:社會法的傾斜性保護原則要把握好度,防止因過分絕對而對社會產生負面效應。 第二部分,社會法傾斜性保護原則的意義。社會法傾斜性保護原則的確立對弱勢群體社會權的實現具有極其重要的意義。從理論上講,它體現了社會公平正義的價值追求,是國家理性的選擇;從現實上講,它是和諧社會建設的必然要求,是現代法治文明的重要標志。 第三部分,社會法傾斜性保護原則的憲法基礎與法律體現。從社會權的產生、發(fā)展、分類入手,明確了社會權問題是憲法問題,因此,弱勢群體社會權的保障有必要寫入憲法。憲法對弱勢群體社會權的保障,不僅有利于增強弱勢群體的生存與競爭力,充分體現人道主義關懷,而且有助于確保社會的穩(wěn)定與安全,還有利于弘揚公平、正義、和諧的價值觀念。通過分析我國憲法對弱勢群體社會權保護的現狀,筆者認為,實現憲法規(guī)定的可操作性關鍵要靠相關具體法律,即社會法是實現弱勢群體社會權的重要保障,而在社會法中貫徹傾斜性保護原則又是弱勢群體社會權得以實現的根本途徑。同時筆者對傾斜性保護原則的法律體現進行了分析。 第四部分,社會法傾斜性保護原則指引下的法制建設。要使社會法傾斜性保護原則得以落實,還要解決方法問題,使其具有可操作性。因此,必須從社會整體角度出發(fā),建立全方位的法律機制。筆者認為,應當以社會法傾斜性保護原則為導向,完善社會法的傾斜立法體系;建立相關制度,實現傾斜性保護,諸如社會保障制度、法律援助制度、公益訴訟制度等;強化政府責任,增強公民權利觀念。
[Abstract]:The principle of preferential protection of social law, adhering to the concept of different situations and different treatment, based on the specific differences between the parties and the resulting substantive inequality of social relations, and regard this unequal relationship as the object of regulation. The unequal treatment principle is used to correct the phenomenon of inequality so that the unbalanced social relations can be restored and the rights of the vulnerable groups can be guaranteed. In the context of constitutionalism, taking social rights as the fulcrum, this paper begins with the background analysis of the principle of social law's tilt protection, expounds the meaning of the principle of social law's inclination protection, and probes into the constitutional basis of the principle of social law's inclination protection. This paper analyzes the theoretical and practical significance of the principle of social law tilt protection, and discusses how to carry out the legal system construction under the guidance of the social law tilt protection principle combined with the reality of our country. Full text more than 40,000 words, a total of four parts. The first part is an overview of the protection principle of social law. The second part, the significance of the principle of social law protection. The establishment of social law protection principle is of great significance to the realization of social rights of vulnerable groups. Theoretically, it embodies the value pursuit of social fairness and justice and is the rational choice of the country. In reality, it is the inevitable requirement of the construction of a harmonious society and an important symbol of the modern civilization of rule of law. The third part, the constitutional basis and legal embodiment of the social law protection principle. Starting with the emergence, development and classification of social rights, it is clear that the issue of social rights is a constitutional issue, therefore, the protection of social rights of vulnerable groups is necessary to be written into the Constitution. The protection of the social rights of the vulnerable groups by the Constitution is not only conducive to enhancing the survival and competitiveness of the vulnerable groups, fully embodying humanitarian concern, but also conducive to ensuring social stability and security, and also conducive to the promotion of fairness and justice. Harmonious values. By analyzing the current situation of the protection of the social rights of the vulnerable groups under the constitution of our country, the author thinks that the key to realize the maneuverability of the constitution depends on the relevant specific laws, that is, the social law is the important guarantee to realize the social rights of the vulnerable groups. The basic way to realize social rights of vulnerable groups is to implement the principle of preferential protection in social law. At the same time, the author analyzes the legal embodiment of the principle of tilt protection. The fourth part, the legal system construction under the guidance of the social law inclination protection principle. In order to implement the principle of social law protection, it is necessary to solve the problem of method and make it operable. Therefore, we must set up a comprehensive legal mechanism from the perspective of the whole society. In my opinion, we should perfect the legislative system of social law, establish relevant system and realize the protection of social law, such as social security system, legal aid system, public interest litigation system, etc. Strengthen the responsibility of the government and strengthen the concept of civil rights.
