【摘要】：陪審團(tuán)廢法制度的歷史是人民爭(zhēng)取自由的歷史。陪審團(tuán)廢法起源于英國(guó)人民反抗王室利用法院迫害批判者,在殖民地時(shí)期用于反對(duì)殖民者的暴政,在美國(guó)建國(guó)后它成為了民權(quán)運(yùn)動(dòng)的守護(hù)神。陪審團(tuán)廢法被濫用導(dǎo)致法官限制陪審團(tuán)廢法,法官限制陪審團(tuán)廢法侵犯了被告人享有陪審團(tuán)審判的權(quán)利,也侵犯了陪審團(tuán)廢法倡導(dǎo)者的言論自由。陪審團(tuán)廢法是陪審制內(nèi)在機(jī)制的產(chǎn)物,具有正當(dāng)性。雖遭質(zhì)疑和批判,陪審團(tuán)廢法在陪審制國(guó)家始終具有存在的正當(dāng)性。
[Abstract]:The history of jury annulment is the history of the people's struggle for freedom. Jury repeal originated in the British people's resistance to the use of the court to persecute critics, used against colonial tyranny in the colonial period, after the founding of the United States it became the patron saint of the civil rights movement. The abrogation of jury law leads to the judge restricting the abrogation of jury, which infringes on the defendant's right to jury trial and infringes on the freedom of speech of jury abrogation advocate. The juries abrogation is the product of the internal mechanism of jury system, and it has legitimacy. Despite being questioned and criticized, the jury abrogation law has always had the legitimacy in the jury system country.
