【摘要】： 法律的合法性問題屬于哈貝馬斯合法性理論中的子問題。合法性追問是一種典型的價(jià)值追問。在哈貝馬斯的合法性理論中,對法律的合法性討論具有重要的意義。法律的合法性問題是對商談理論進(jìn)行必要性論證的前提,回答了我們?yōu)槭裁匆䦶姆蛇@一根本性問題。簡單來說,哈貝馬斯理論體系的證成過程就是采用交往理性取代傳統(tǒng)的實(shí)踐理性,并通過普遍語用學(xué)將交往行為理論、商談理論與法律理論聯(lián)系起來。在這一過程中,哈貝馬斯抽象出事實(shí)性與規(guī)范性這一對范疇作為其法律理論分析的基本概念,通過對這對范疇之間的緊張關(guān)系的揭示來解決法律的合法性問題。并引入商談理論來調(diào)和這種緊張關(guān)系,從而解決法律的有效性問題。作為交往行為理論在法律領(lǐng)域的延伸,哈貝馬斯希望通過法律商談理論來為生活世界提供規(guī)范標(biāo)準(zhǔn)與程序參照。他期待通過公共領(lǐng)域里的對話協(xié)商來獲得普遍性的法律共識(shí)。他的這一理論嘗試促成了法律合法性問題的理性重構(gòu),并將商談理論引入立法與司法過程中。通過建立立法與司法的協(xié)商民主模式,為人們“為什么要遵守法律?”、“遵守怎樣的法律?”這些根本問題給出了理想而樂觀的答案。然而,建立于商談基礎(chǔ)之上的法律合法性與現(xiàn)實(shí)之間依然存在著難以彌合的鴻溝,但這也恰恰成為了沿著這一思路繼續(xù)探索的出發(fā)點(diǎn)。此外,法律合法性問題對中國法治社會(huì)建設(shè)中的幾個(gè)重要問題提供了有益的借鑒。這些問題包括如何通過“法律合法性”塑造中國民眾的法治觀念；如何界定法、權(quán)關(guān)系的合法性問題；以及程序民主的合法性內(nèi)涵問題。
[Abstract]:The legality of law belongs to the sub-problem in Habermas's theory of legitimacy. Legality questioning is a typical value question. In Habermas's theory of legality, it is of great significance to discuss the legality of law. The legality of the law is the premise of the necessity of the discussion theory, which answers the fundamental question of why we should obey the law. To put it simply, Habermas' proof process is to adopt communicative rationality instead of traditional practical rationality, and to connect communicative behavior theory, negotiation theory and legal theory through universal pragmatics. In this process, Habermas abstracts a pair of categories of fact and normality as the basic concept of his legal theoretical analysis, and solves the legality of law by revealing the tense relationship between the categories. And the theory of negotiation is introduced to reconcile the tension, so as to solve the problem of the effectiveness of the law. As an extension of communicative behavior theory in the field of law, Habermas hopes to provide normative standards and procedural references for the world of life through the theory of legal negotiation. He looked forward to universal legal consensus through dialogue and consultation in the public sphere. His theoretical attempt contributed to the rational reconstruction of legal legality and brought the theory of negotiation into the process of legislation and judicature. By establishing a model of deliberative democracy between legislation and the judiciary, "Why should we abide by the law?" and "what kind of laws should we abide by?" These fundamental questions provide an ideal and optimistic answer. However, the gap between legal legitimacy and reality, which is based on negotiation, is still difficult to bridge, but this has become the starting point of further exploration along this line of thought. In addition, the issue of legal legitimacy provides a useful reference for several important issues in the construction of China's legal society. These problems include how to shape the concept of Chinese people's rule of law through "legal legitimacy", how to define the legality of law and the legitimacy of power relations, and the connotation of legitimacy of procedural democracy.
