【摘要】： 我國古代社會發(fā)展了多種多樣的人才選拔制度,這是社會發(fā)展的需要�？婆e考試是中國古代社會最為重要的考試制度,直至清末廢止。但考試作為一種選拔人才的方法,在沒有更好的途徑代替其之前,其必將存續(xù)發(fā)展。在孫中山考試權(quán)思想的指導(dǎo)下,民國時期的文官考試立法逐步完善,在選拔人才方面,特別是對民國時期的文官考試起到積極的影響。本文以民國時期的文官考試立法為選題,一來希望對民國時期的文官考試立法作一個清晰的描述,二來則是要借鑒當(dāng)時的文官考試立法的科學(xué)合理之處,以期完善我國當(dāng)前的考試立法,特別是對當(dāng)前的公務(wù)員錄用考試制度、立法層面更具啟發(fā)意義。 本文先是對近代中國考試制度的轉(zhuǎn)型進(jìn)行分析,文中重點分析新式學(xué)堂教育興起和孫中山考試權(quán)思想對新的考試制度的建立、文官考試立法出現(xiàn)的影響。進(jìn)而對民國四個不同時期的文官考試立法歷程進(jìn)行論述,考察它是一個怎么樣的進(jìn)程。再次就是展開民國時期考試立法的評析,我們會發(fā)現(xiàn):民國時期的文官考試立法不但全面,而且立法相當(dāng)科學(xué),形成了一個嚴(yán)密的考試法體系,對當(dāng)時的人才選拔起到了較好的作用。但是由于國民黨的專制以及戰(zhàn)亂,民國時期文官考試立法的實施并不理想。 中國過去是考試的故鄉(xiāng),今天依然是考試大國。各類考試數(shù)目繁多,參加考試的規(guī)模巨大,考試涉及很多人的權(quán)利,乃至影響整個社會的發(fā)展,合理科學(xué)的考試制度很重要。但是我國目前考試立法卻嚴(yán)重滯后,不但立法層次低,而且不能及時修改完善,甚至存在立法空白。這無法適應(yīng)我國考試的發(fā)展,還會阻礙社會的發(fā)展。我們應(yīng)該從考察民國時期的文官考試立法中得到啟示,完善我國相關(guān)的考試立法,調(diào)整考試行為,做到依法治考。 民國時期文官考試立法對當(dāng)今我國公務(wù)員錄用考試也有很大的借鑒意義,取其長處將有助于我國建立公開、平等的公務(wù)員考試制度,最大程度發(fā)揮考試制度的擇優(yōu)作用,選拔真正優(yōu)秀的人才。如此不但能保障應(yīng)試者的權(quán)利,對整個社會的發(fā)展也將起到積極的推動作用。
[Abstract]:China's ancient society developed a variety of talent selection system, which is the need of social development.Imperial examination was the most important examination system in ancient China until the end of Qing Dynasty.But the examination, as a method of selecting talents, will continue to develop before it is replaced by a better way.Under the guidance of Sun Zhongshan's thought of examination right, the civil service examination legislation in the period of the Republic of China was gradually perfected, and played a positive influence on the selection of talents, especially on the civil service examination in the period of the Republic of China.This article takes the civil service examination legislation in the period of the Republic of China as the topic, hopes to make a clear description of the civil service examination legislation in the period of the Republic of China, and draws lessons from the scientific and reasonable place of the civil service examination legislation at that time.In order to perfect our current examination legislation, especially to the current civil servant recruitment examination system, the legislative level is more enlightening.This paper first analyzes the transformation of modern China's examination system, focusing on the rise of new school education and Sun Zhongshan's thought of examination right on the establishment of the new examination system, and the emergence of civil service examination legislation.Then it discusses the legislative process of civil service examination in four different periods of the Republic of China, and examines what kind of process it is.The third is to comment on the examination legislation during the Republic of China. We will find that the civil examination legislation during the Republic of China is not only comprehensive, but also quite scientific, forming a rigorous examination law system.At that time, the talent selection played a better role.However, due to the despotism and war of the Kuomintang, the implementation of civil service examination legislation in the Republic of China was not ideal.China used to be the hometown of exams, but today it is still a big country.There are many kinds of examinations and the scale of taking them is huge. The examination involves the rights of many people and even affects the development of the whole society. A reasonable and scientific examination system is very important.However, at present, the examination legislation in our country lags behind seriously, not only the legislative level is low, but also the examination legislation can not be modified and perfected in time, and even there is a legislative blank.This can not adapt to the development of the examination in China, but also hinder the development of society.We should learn from the civil examination legislation in the period of the Republic of China, perfect the relevant examination legislation in our country, adjust the examination behavior, and manage the examination according to law.The civil service examination legislation in the period of the Republic of China also has great reference significance to our country civil servant employment examination nowadays, takes its strong point will help our country to establish the open, the equal civil servant examination system, to exert the examination system the best function to the greatest extent.Select really good people.This will not only protect the rights of candidates, but also play a positive role in the development of society.
