【摘要】： 刑名是一個(gè)法學(xué)基本概念,亦即刑罰的名稱。迄今為止中國(guó)古代刑名的研究仍局限在法學(xué)領(lǐng)域,研究者多為法學(xué)界學(xué)者,他們?cè)谘芯恐写蠖鄬⒐糯塘P看作古代刑法史的基本組成部分,重點(diǎn)對(duì)某個(gè)刑罰的有無進(jìn)行說明,而缺少詳盡的考證,致使古代刑名的研究仍然處于比較薄弱的階段。本論文嘗試以新的視角為切入點(diǎn),將古代刑名看作古漢語詞匯系統(tǒng)的一部分,采用語言文化相結(jié)合的方法對(duì)中國(guó)古代刑名進(jìn)行研究。具體方法為,在充分利用現(xiàn)有法律材料的基礎(chǔ)上滲入語言分析因素,詮考每個(gè)刑名的命名、演進(jìn)、特征、相關(guān)詞語、文化背景等方面內(nèi)容。既有對(duì)刑名的解釋說明,也有對(duì)一些疑點(diǎn)難點(diǎn)的考證。這些研究可使刑名研究在概念上更趨準(zhǔn)確嚴(yán)密,在內(nèi)容上更加豐富翔實(shí),因而對(duì)法學(xué)領(lǐng)域具有一定的參考作用。另外,由于刑名研究的不足,使得部分字典辭書中的有關(guān)刑名詞條的注解也存在一些不準(zhǔn)確、錯(cuò)誤、漏釋等問題。本文對(duì)此進(jìn)行了分析并提出了自己的意見,希望對(duì)辭書的進(jìn)一步完善有所幫助。 本文的緒論介紹了古代刑名的研究現(xiàn)狀;正文研究了65個(gè)刑名,這些刑名根據(jù)性質(zhì)特征分為五類,即生命刑、身體刑、自由刑、財(cái)產(chǎn)刑和恥辱刑;最后是附錄,有專題研究,刑罰存現(xiàn)表和插圖。
[Abstract]:Criminal name is a basic concept of law, that is, the name of penalty.Up to now, the study of Chinese ancient criminal names is still confined to the field of law, and the researchers are mostly legal scholars. In their studies, most of them regard ancient punishment as a basic part of the history of ancient criminal law, and focus on the explanation of the existence or absence of a certain penalty.But the lack of detailed textual research, resulting in the ancient criminal name is still in a relatively weak stage.This thesis attempts to use a new angle of view to study the ancient Chinese criminal names by combining language and culture as part of the lexical system of ancient Chinese.The specific methods are as follows: on the basis of making full use of the existing legal materials, the factors of language analysis are infiltrated, and the naming, evolution, characteristics, relevant words and cultural background of each criminal name are analyzed.Not only the explanation of criminal name, but also the textual research of some doubtful points and difficulties.These studies can make the study of criminal name more accurate and precise in concept and rich in content, so it has a certain reference role in the field of law.In addition, due to the lack of research on criminal names, there are some inaccuracies, errors and misinterpretations in some dictionaries.This paper analyzes this and puts forward its own opinions, hoping to be helpful to the further perfection of the dictionaries.The introduction of this paper introduces the research status of ancient criminal names, the text studies 65 criminal names, which are divided into five categories according to their nature, namely, life punishment, body punishment, freedom punishment, property punishment and humiliating punishment.Tables and illustrations of penalties.
