論馬克思自然法觀

【摘要】: 本文重新闡釋了馬克思的法律理論,論證了這種法律理論可以在廣泛的自然法傳統(tǒng)內(nèi)找到自己合適的位置。筆者將這種法律理論稱之為“法律自然主義”理論,即馬克思的自然法觀。法律自然主義理論與其他的自然法理論共同分享了自然法傳統(tǒng)的三大主要特征:第一,它假定了法律的二元存在:自然法和實在法;第二,它主張實在法是自然法的產(chǎn)物,自然法優(yōu)位于實在法。自然法為實在法提供鑒別、評判和衡量的標(biāo)準(zhǔn)。第三,它建立了應(yīng)該是什么的自然法和實際上是什么的實在法之間的橋梁,實在法要奮力去實現(xiàn)自然法。所有的自然法理論都共享這三項特征。當(dāng)然,馬克思主義的自然法觀與自然法傳統(tǒng)中的其他理論有著不同之處:和其他的自然法理論不同,它認為自然法廣泛的孕育于社會形態(tài)或者生產(chǎn)方式之中。 任何特定社會的實在法都是這個社會深層結(jié)構(gòu)的反映。這些深層結(jié)構(gòu)不僅僅是經(jīng)濟的。它們是法律的,但是是自然生成法律的。它們由那些對社會形態(tài)來講本質(zhì)的、必需的法律關(guān)系所構(gòu)成,如果某一社會形態(tài)缺乏了它們,那么它將不會是現(xiàn)在這個社會形態(tài)而是其他類型的社會形態(tài)了。從這種意義上來講,由這些必需的法律關(guān)系所構(gòu)成的自然法構(gòu)成并同時反映了這個社會中權(quán)利的結(jié)構(gòu)。當(dāng)我們說某一既定社會的實在法是其深層結(jié)構(gòu)的法律表達的時候,意味著它是此社會生產(chǎn)方式的構(gòu)成性的自然法的表達。 就好像其他自然法理論把法視為來源于某事物的本質(zhì)那樣,馬克思法律觀認為這種由某一社會實在法所表達的自然法是其生產(chǎn)方式本質(zhì)的一個構(gòu)成部分。因此,本文稱馬克思的這種法律理論為“法律自然主義”,即自然法觀。這種自然法具有客觀性、獨立性,不是永恒的,是歷史的。它不僅在理論上是有益的,而且是有資格勝任實踐的。
[Abstract]:This paper reinterprets Marx's legal theory, and proves that this kind of legal theory can find its proper position in the extensive natural law tradition, and the author calls this kind of legal theory "legal naturalism" theory. That is, Marx's view of natural law. Legal naturalism theory and other natural law theories share three main characteristics of natural law tradition: first, it assumes the dual existence of law: natural law and positive law; second, It argues that positive law is the product of natural law, and that natural law predominance lies in positive law. Natural law provides criteria for the identification, evaluation and measurement of positive law. Third, It establishes a bridge between the natural law of what is supposed to be and the positive law of what is in fact, which strives to realize natural law. All natural law theories share these three characteristics. Of course, The Marxist view of natural law is different from other theories in the tradition of natural law: unlike other theories of natural law, it holds that natural law is widely conceived in the social form or mode of production. The positive law of any particular society is a reflection of the deep structure of the society. These deep structures are not only economic. They are legal, but they are naturally generated. The necessary legal relationships, if a certain form of society lacks them, then it will not be the present form of society, but other types of social formation. In this sense, The natural law formed by these necessary legal relationships and at the same time reflects the structure of rights in this society... when we say that the positive law of a given society is the legal expression of its deep structure, It means that it is the constitutive expression of natural law of this social production mode. Just as other natural law theories regard law as derived from the nature of something, Marx's legal view considers this kind of natural law, expressed by the positive law of a given society, to be a component of the essence of its mode of production. This article calls this kind of legal theory of Marx "legal naturalism", that is, the view of natural law. This kind of natural law is objective, independent, not eternal and historical. And qualified for practice.
