【摘要】： WTO主張各成員實(shí)行貿(mào)易自由化,逐步開放貨物和服務(wù)市場(chǎng),促進(jìn)國際貿(mào)易和世界經(jīng)濟(jì)的發(fā)展。但它對(duì)開放市場(chǎng)后可能對(duì)成員經(jīng)濟(jì)貿(mào)易發(fā)展帶來的影響也予以關(guān)注,對(duì)貿(mào)易自由化的風(fēng)險(xiǎn)也相應(yīng)地制定了一系列條款或協(xié)議加以防范,允許其成員建立自己的符合WTO規(guī)范的保障機(jī)制,對(duì)本國產(chǎn)業(yè)實(shí)行合理與適度的保護(hù)。WTO框架下的反傾銷、反補(bǔ)貼、保障措施等旨在維護(hù)進(jìn)出口公平貿(mào)易的貿(mào)易救濟(jì)措施是各國最常用的,也是被WTO制度化了的規(guī)則導(dǎo)向的主要部分。通過對(duì)WTO貿(mào)易救濟(jì)制度的成本收益分析可知,各國采取的貿(mào)易救濟(jì)措施有時(shí)并非是有效率的,但并不妨礙它作為貿(mào)易政策工具被廣泛地使用,因此,從某種意義上講,反傾銷等貿(mào)易救濟(jì)措施的政治性多于經(jīng)濟(jì)性。WTO貿(mào)易救濟(jì)制度的設(shè)計(jì)本意是降低交易成本,推動(dòng)多邊貿(mào)易的自由化,而WTO貿(mào)易救濟(jì)規(guī)則的異化卻將維護(hù)公平競(jìng)爭(zhēng)的規(guī)則演變?yōu)榉垂礁?jìng)爭(zhēng)的規(guī)則,進(jìn)而增加了交易成本,阻礙了公平貿(mào)易的實(shí)現(xiàn)。伴隨著經(jīng)濟(jì)危機(jī)影響的加深,抵制貿(mào)易保護(hù)的呼聲并沒有抑制住全球貿(mào)易摩擦案件的迅速上升。事實(shí)證明,過分的貿(mào)易救濟(jì)措施不僅會(huì)傷害對(duì)方,也會(huì)傷及本國國內(nèi)下游產(chǎn)業(yè)及消費(fèi)者的利益,同時(shí),貿(mào)易伙伴的報(bào)復(fù)也會(huì)日漸增多。本文從法經(jīng)濟(jì)學(xué)的視角,運(yùn)用供給需求、成本收益、公共選擇等理論分析了WTO框架下貿(mào)易救濟(jì)制度的公平和效率,探討了當(dāng)前一些國家濫用貿(mào)易救濟(jì)措施的深層次原因,提出了中國應(yīng)對(duì)國外貿(mào)易救濟(jì)和應(yīng)用貿(mào)易救濟(jì)應(yīng)采取的策略。
[Abstract]:WTO advocates that members should liberalize their trade, open up the markets of goods and services step by step, and promote the development of international trade and world economy. Accordingly, a series of articles or agreements have been made to prevent the risks of trade liberalization, allowing its members to establish their own safeguard mechanism in line with the WTO norms, and to carry out reasonable and appropriate protection of domestic industries against anti-dumping under the framework of WTO. Countervailing measures, safeguard measures and other trade relief measures aimed at maintaining fair trade between imports and exports are the most commonly used trade relief measures in various countries, and are also the main part of the rule-oriented system institutionalized by the WTO. Through the cost-benefit analysis of the WTO trade relief system, we can know that, Trade relief measures taken by countries are sometimes not efficient, but do not prevent their widespread use as instruments of trade policy, and thus, in a sense, Anti-dumping and other trade relief measures are more political than economic. WTO trade relief system is designed to reduce transaction costs and promote multilateral trade liberalization. However, the dissimilation of WTO trade relief rules turns the rules of maintaining fair competition into anti-fair competition rules, which increases transaction costs and hinders the realization of fair trade. Calls for a boycott of trade protection have not stopped the rapid rise in global trade frictions. Excessive trade remedies have proved to hurt not only the other side, but also the interests of downstream industries and consumers at home. From the perspective of law and economics, this paper analyzes the fairness and efficiency of trade relief system under the framework of WTO by using the theories of supply demand, cost benefit and public choice. This paper probes into the deep-seated causes of the abuse of trade relief measures in some countries, and puts forward the strategies that China should take to deal with foreign trade relief and apply trade relief.
