【摘要】：什么是法治?這是個長久以來爭論不休的話題。一般而言對法治的論述大體上可分為三類:"形式論述聲稱,法律的來源、制定與適用,必須具備一定的形式要件;實(shí)質(zhì)論述主張,法律的內(nèi)容,必須受某些實(shí)質(zhì)要件的限制;綜合論述則強(qiáng)調(diào),法律的形式與實(shí)質(zhì)要件不可偏廢。主張法治應(yīng)以形式要件為重的論點(diǎn),可統(tǒng)稱為形式法治理論,而主張以實(shí)質(zhì)要件為重的論點(diǎn),則稱為實(shí)質(zhì)法治理論。在當(dāng)代西方的法政論述中,不乏對這兩種理論做深入學(xué)理探討的研究,其中尤以美國法學(xué)者塔瑪納哈所做的比較分析,最為完備周延。"[1]本文選取塔瑪納哈在《論法治——?dú)v史、政治和理論》一書中對于法治理論構(gòu)想的分析為基本切入視角,結(jié)合塔瑪納哈在此基礎(chǔ)上所總結(jié)的法治的三個共通主題,展現(xiàn)塔瑪納哈理論中對一般法理學(xué)與社會-法實(shí)證主義的運(yùn)用。所希望著重展現(xiàn)的正是這樣一種經(jīng)由塔瑪納哈的社會-法實(shí)證分析,將法治置于歷史、社會與政治語境下的理解。
[Abstract]:What is the law? This is a long debated topic. General discussion of the rule of law can be divided into three categories: "this form of claim, legal sources, formulation and application, must have certain formal requirements; discusses the essence that the contents of law, must be subject to certain substantive restrictions; a comprehensive discussion is stressed, legal form and substantive elements. Should advocate the rule of law with the formal elements for heavy arguments can be referred to as the form of the rule of law theory, and advocated substantial requirements for heavy arguments, then known as the essence of law governance theory in contemporary western politics. In the paper, some do in-depth academic research study on the two theories, especially in the United States law Tamanaha has done comparative analysis, the most complete distribution. This paper selects" [1] Tamanaha "on the rule of law, history, politics and the theory of" a book for the theory of rule of law The idea of analysis as the basic point of view, combined with the three common themes of Tamanaha on the basis of the summary of the rule of law, show the use of general jurisprudence and social positivism of Tamanaha's theory.
